The Unilateral Bibi

Bibi Netanyahu’s highly anticipated appearance on Tuesday at the Center for American Progress did not contain many surprises. Netanyahu spent much of the hour doing a masterful job of communicating his talking points, maneuvering questions onto advantageous territory, and using the yawning chasm between his knowledge and CAP President Neera Tanden’s knowledge of Israel and the Israeli-Palestinian conflict to push across his worldview largely unchallenged. There was, however, one notable moment at the very end that was immediately picked up on by those in the room and later caused a ruckus back in Israel. Circling back to an earlier question from Washington Institute fellow David Makovsky on what Netanyahu’s Plan B is to prevent Israel from becoming a bi-national state, Netanyahu stated about unilateralism, “I suppose that is possible, but it would have to meet Israeli security criteria.”

As someone who has championed unilateralism as a way to avoid having the peace process kill the two state solution, I found this ever so slight opening heartening, and indeed, an Israeli diplomat told me immediately following Netanyahu’s appearance that the line was not a throw away but something that has been the subject of recent discussion. As is so often the case with Netanyahu, however, things are not always as they seem and politics gets in the way. Politicians on the right immediately insisted that Netanyahu could not possibly have been calling for a unilateral territorial withdrawal and declared that unilateralism is great if it means annexing Area C as opposed to withdrawing from it. A Likud spokesman dubbed unilateral withdrawal as a mistake that won’t be repeated and said people misinterpreted what Netanyahu said. Then Netanyahu himself backpedaled, stating on his Facebook page that he was not talking about withdrawal and that he has no intention of uprooting any settlements. So much for that.

Nonetheless, Netanyahu should not have been so hasty to disavow in Hebrew what he said in English. Unilateral withdrawal makes sense in a lot of ways, and it can be done in a way that fulfills Netanyahu’s stated concern about meeting Israeli security criteria. Given the current environment, in which Netanyahu does not want to negotiate in the face of terrorism, Mahmoud Abbas does not want to negotiate with Netanyahu at all, and the Obama administration has now publicly thrown up its hands at the idea of getting a negotiated agreement during the remainder of Obama’s term, unilateral withdrawal may in fact be the best way to safeguard Israel’s security.

Asher Susser recently wrote about basic security versus current security in the context of the terrorist attacks in Jerusalem. Basic security seeks to safeguard the fundamentals of the Zionist enterprise in keeping Israel Jewish and democratic, while current security seeks to safeguard the basic daily well-being of Israeli citizens. On the issue of basic security, it is a nearly impossible battle to argue that keeping the West Bank indefinitely preserves the Zionist enterprise, and indeed Netanyahu himself has conceded as much. The most oft-stated objection to pulling out of the West Bank that comes from Netanyahu and others on the right – leaving aside the religious and ideological attachments to the entirety of the Land of Israel – is that a withdrawal would leave a terrorist state in the West Bank and destroy any semblance of Israel’s current security.

One of the problems that Israel faces is that Netanyahu has consistently prioritized Israel’s current security over its basic security, sacrificing the long term in service of the short term. But another is that even when it comes to basic security, Netanyahu’s views are either influenced by political calculations or are narrowly conventional. Netanyahu states without qualification that withdrawing from the West Bank would be a security disaster, but this assumes a full military withdrawal as took place in Gaza in 2005. Given what transpired in the aftermath, few people contemplate unilateral withdrawal from the West Bank as including the entirety of the IDF presence there; when people with impeccable security credentials such as Amos Yadlin advocate for unilateral disengagement, they explicitly exclude withdrawing all IDF troops or even leaving the Jordan Valley. Netanyahu’s rejection of disengagement from the West Bank by pointing to Gaza also ignores the subsequent decade of robust and successful security cooperation with the Palestinian Authority in the West Bank, and the fact that even were Israel to withdraw, the PA would have every incentive to continue to keep things quiet. Not all withdrawals are of the same flavor, and in spending years ruling out a West Bank disengagement and immediately reversing course after floating a trial balloon this week at CAP, Netanyahu is missing a chance to potentially establish Israel’s basic security for good while guaranteeing its current security.

Rather than accede to the politics of his coalition partners and his ministers, Netanyahu should seriously contemplate unilaterally declaring a provisional border with the West Bank, evacuating the settlements beyond that unilateral provisional border, keeping a military presence in the Jordan Valley, and telling the Palestinian Authority that he is happy to negotiate an agreement for permanent borders any time. It would be great if negotiations toward a final status agreement were proceeding swimmingly, but there are scores of reasons why they aren’t, and aren’t destined to be for the foreseeable future. Makovsky’s question to Netanyahu about a backup plan prompted an answer that many don’t like, but that doesn’t mean that it wasn’t a good one. Some productive unilateralism would go a long way toward putting the two state solution back on solid ground.

When Zionists Boycott

Last weekend, the Washington Post ran an op-ed by Steven Levitsky and Glen Weyl, professors respectively at Harvard and Chicago (which has made for a dangerous combination in the past), arguing for a boycott of Israel. Levitsky and Weyl, both self-identified as progressive Jews and lifelong Zionists, argue that because their support for Israel is predicated in part on the Jewish state embracing universal values of human rights, their observation that the occupation of the West Bank has become permanent dictates a boycott. They write that the purpose of a boycott is to pressure Israel into altering its strategic calculations and change its behavior; in their words, “Until Israel seriously engages with a peace process that either establishes a sovereign Palestinian state or grants full democratic citizenship to Palestinians living in a single state, we cannot continue to subsidize governments whose actions threaten Israel’s long-term survival.”

Given the pedigree and prominence of the authors, this particular call to boycott Israel has caused some consternation and drawn a variety of harsh responses, with some points of substance but mostly loud verbiage questioning the authors’ fitness to comment on Israel or diagnosing their allegedly selfish emotional motivations behind writing the op-ed. If you are looking for another ad hominem attack against Levitsky and Weyl or an investigation into their psyches, you needn’t read any further since one will not be forthcoming in this space. I am more interested in demonstrating why I think the particular arguments they make are inapt and figuring out how they arrived at the view of Israel that they espouse.

I am passingly acquainted with Levitsky personally from my days at Harvard, but I am intimately acquainted with his influential and excellent work on competitive authoritarianism. Competitive authoritarian regimes are ones where the authoritarian government holds elections that can theoretically result in the opposition coming to power, but the process is not free and fair and is heavily weighted in the regime’s favor. This work on competitive authoritarianism is part of a wider literature in political science recognizing that not only are elections not a sufficient condition for democracy, but that in many cases elections are part of a wider system of placing a democratic veneer on authoritarian government. A competitive authoritarian regime may look like a democracy but behind the scenes is actually working to unfairly perpetuate its own rule; think about Vladimir Putin’s Russia or Tayyip Erdoğan’s Turkey for a current snapshot of what that looks like.

I bring this up because in reading Levitsky and Weyl’s argument, it jumps out at me that they are taking Levitsky’s work on competitive authoritarian regimes and superimposing it – inappropriately, in my view – on Israel. From their vantage point, Israel is denying basic rights to Palestinians in the West Bank, growing the settler population, mistreating its Arab minority, and generally using its advantage over the Palestinians to ensure that they live in permanent subjugation. Much like a competitive authoritarian regime holds elections that can theoretically result in a change in government but only if the opposition overcomes the significant hurdles and unfair disadvantages that the ruling party places in its path, Levitsky and Weyl see Israel periodically engaging in a peace process that can theoretically result in a Palestinian state but placing too many hurdles in the way of such a process being successful. In short, while never explicitly writing it, Levitsky and Weyl view Israel as engaging in competitive authoritarian behavior in a number of ways.

It is thus unsurprising given Levitsky’s research showing that competitive authoritarian regimes with strong ties to the West respond to pressure to democratize that he and Weyl came up with the prescription that they did. They are convinced that by isolating Israel from the West and placing its financial and diplomatic ties to the U.S. in jeopardy, it will create sufficient pressure to get Israel to take the peace process seriously and step back from the brink in ending the occupation. As they write, “We recognize that some boycott advocates are driven by opposition to (and even hatred of) Israel. Our motivation is precisely the opposite: love for Israel and a desire to save it.”

I take the authors’ professed love for Israel at face value, but the problem with their plan to address Israel’s behavior through boycotts and sanctions is that their misdiagnosis of the situation leads them to prescribe medicine that will not cure this particular disease. One of the defining characteristics of authoritarian states is that the power to alter course is entirely in the hands of the regimes; not only is there an extreme power imbalance with respect to the opposition, but the regime holds all of the cards in terms of opening up to democracy and competition. Levitsky and Weyl proceed based on an assumption that pressure on Israel will ipso facto lead to the creation of a Palestinian state and the end of an Israeli presence in the West Bank because it is in Israel’s power to do so at will given the right set of incentives. While many, including me, do not view the current Israeli government as in any way serious about the two state solution, the fact remains that successive Palestinian leaders and governments have turned down Israeli offers of statehood without so much as a counter response. This is not a scenario in which Israel can snap its fingers and create a new reality, or one in which Israel is solely to blame for the situation that exists. Israel can and should do better, particularly when it comes to settlement activity, but it does not automatically follow that a boycott of Israel will address the problem at hand, and that is without even factoring in Israel’s legitimate security concerns.

Levitsky and Weyl address head on the common critique that boycotting Israel constitutes a double standard by acknowledging that, no, Israel is not the world’s worst human rights violators, but that they also feel far more invested in Israel’s future fate than they do of other states. As someone who spends his time working on Israel rather than on Bulgaria or Comoros, I empathize with this position, but it again overlooks a crucial reality. While Levitsky and Weyl may be motivated by genuine concerns, their course of action ends up being discriminatory in effect if not in intent far beyond their limited scope. It’s one thing for them to care about Israel more than they do about China, but it’s another to actively work to ensure that Israel is treated worse, particularly given the international environment that seizes upon such efforts to argue that Israel is in fact the world’s worst violator of human rights. Just because Levitsky and Weyl acknowledge that Israel is not a rogue nation without parallel does not mean that such understanding will extend to those with a very different agenda who seize upon their call to action.

I understand the frustration with the Israeli government, with the settlement enterprise, with illiberal trends in Israeli society, and with a Jewish state that speaks for Jews everywhere irrespective of whether all Jews want to cede to it that authority. But Israel is still a democracy, and to view it as an authoritarian actor that is susceptible to pressures that work on authoritarian states leads to poor policy prescriptions. A boycott is the wrong approach, both morally and practically, and Levitsky and Weyl’s op-ed is an example of the road to hell being paved with good intentions.

Unholy Fire on the Temple Mount

As terrorist attacks on Israeli civilians proliferate across Jerusalem and other Israeli cities, everyone seems to be hoping that a combination of a greater Israeli military and police presence on the streets and the Palestinian Authority holding the line on larger organized attacks will prevent further violence. While everyone recognizes that there are no perfect solutions, the nature of this nascent uprising is more dangerous than those that have come before because of the fusion of political nationalism and religious nationalism. The Temple Mount has always been in the background imagery of the Israeli-Palestinian conflict, but now it is front and center and it does not bode well for what is to come.

The PA is largely impotent here because the attacks are being carried out by Palestinians from East Jerusalem, who are not under the PA’s jurisdiction, and the primary motivation is the most dangerous one of all, which is a perceived threat to Muslim dominance of the Temple Mount. Palestinians (and Jordanians, and the Arab League, and the Turkish government) accuse Israel of altering the status quo on the Temple Mount, and Abbas, the PA, Hamas, the Islamic Movement in Israel, Joint List Arab MKs, and nearly every other actor on the Palestinian side are whipping the Palestinian public into a frenzy over the issue. Because the status quo is an unwritten agreement and because the margins of what precisely it means have shifted over time, there is no consensus as to what precisely it entails, but the basic parameters are solely Muslim prayer on the Temple Mount and some form of access to the Mount for non-Muslims so long as prayer is not involved. From a technical standpoint, and in line with Prime Minister Netanyahu’s constant claims on the subject, the Israeli government has not altered the status quo, as it maintains an official policy of prohibiting Jews from praying on the Temple Mount. Indeed, Netanyahu has gone so far as to ban MKs from the site entirely so as not to risk a potentially explosive incident.

Nevertheless, Palestinians and Muslims worldwide refuse to believe that Israel is not in the midst of violating and attempting to alter the arrangement that has held since 1967. The reasons for this suspicion are that in the past half decade, and even more markedly this year, there have been increased Jewish visits and in larger numbers, along with visits from rightwing government ministers – Uri Ariel most prominent among them – who have prayed on the Mount and publicly demanded that the status quo be changed. This is part of a trend within religious Zionism to embrace the Temple Mount – as opposed to solely the Western Wall – as a site for prayer and a way of asserting Jewish nationalism in contrast to what was once a nearly universal religious prohibition from ascending to the Temple Mount plaza.

Given the involvement of government ministers in this changed dynamic and new restrictions on Muslim access to the Temple Mount during the High Holidays this year for security reasons, it is easy to understand why Palestinians are literally up in arms when their leaders demagogue about a mortal threat to Al-Aqsa. The fact that what Israel has given up in agreeing to this status quo – creating a blatantly discriminatory religious double standard against Jews at the holiest site in all of Judaism – or that by all objective accounts Netanyahu desperately does want to maintain the status quo seems not to matter. Also overlooked is that weapons and explosives were seized from Al-Aqsa by the Israeli police last month after having been stockpiled right under the noses of the Waqf in charge of administering the site, which seems to be quite the violation of the status quo given that weapons stockpiled atop the Temple Mount would almost certainly be used as part of a campaign to deny access to non-Muslims.

Despite the fact that the incitement taking place on social media is centered around the Temple Mount, that Abbas and other Palestinian leaders keep on raging about the Temple Mount, and that attackers who have been apprehended have given defending the Temple Mount as their primary motivation, some refuse to accept the reality of what is taking place. In a widely shared column in the Wall Street Journal, Bret Stephens characterized the wave of terrorist attacks as a Palestinian communal psychosis with no motivation behind it other than to kill Jews. Stephens is absolutely and unreservedly correct that knifing Israelis on the streets is indeed a psychotic and evil act and that there is no rational justification for it. But his dismissal of the Temple Mount status quo motivation wholesale because “Benjamin Netanyahu denies it and has barred Israeli politicians from visiting the site” rings a bit hollow, and not only because in the very next paragraph he quotes Abbas saying, “Al Aqsa Mosque is ours. They [Jews] have no right to defile it with their filthy feet.” It ignores the fact that irrespective of what Netanyahu has actually done to preserve the status quo – something that State Department spokesman John Kirby yesterday confirmed – the perception among Palestinians, including those killing and maiming Israelis, is very different.

Which brings me to the final point, which is the wider context beyond the Temple Mount. To deny the role of the occupation of the West Bank and the second class status of Palestinians in Jerusalem in all of this is to be willfully blind, just as blaming the occupation for this completely is to be dangerously naïve and enables more and uglier violence. There is a middle ground between “the occupation causes terrorism” and “terrorism isn’t related to the occupation at all” and it is vital to keep this in mind, as there are no easy answers or parsimonious narratives that can entirely account for the terrible events happening in Israel. Humans are complex animals and we are capable of processing complex thoughts. Incitement from Palestinian leaders and false claims about the Temple Mount and even outright murderous hatred of Jews may be the spark for the current violence, but it can also simultaneously be true that a nearly half-century long military occupation of the West Bank and blatant mistreatment of Arabs living in a supposedly undivided Jerusalem is the propane supply for the current explosion. To deny the lessons of history on the awesome and destructive power of nationalism and to not see it on display among Palestinians as their nationalist dreams go unrealized is to defy logic, even when there are other factors at play as well.

If there is one lesson to take away from all of this, it is that separation for Israel from the Palestinians is more important than ever, as this is only a taste of things to come. The current violence is being driven by Palestinian women, teenagers, and children who could not care less about the PA leadership, the Oslo Accords, or the PA’s desire to maintain some sense of quiet in order to preserve its own hold on the West Bank. While the PA security forces may be able to keep the lid on organized terror attacks planned by cells in the West Bank, the lone wolf and unorganized attacks taking place on Israeli streets are beyond its control. The disappearance of a sense of safety and security for Israelis during their daily routines illuminates the chimerical fantasy of a one-state solution and provides a glimpse into what ethnic strife in a bi-national state might look like. Terror cannot and should not be rewarded, but there also needs to be a greater sense of urgency to come up with a solution that will ameliorate this situation for good.

Turning Lemons Into Rotten Lemons

Last night Jeffrey Goldberg tweeted an apt point that all supporters of Israel should think about very hard. He wrote, “Two things can be true at the same time: Israel is judged more harshly than any other nation–and, Netanyahu is behaving terribly.” Israel is subjected to double standards to which no other country is held, and if you think that isn’t true, consider the nearly single-minded focus on Israel that is the hallmark of the United Nations General Assembly and Human Rights Council, or the harsh spotlight trained upon Israel over civilian casualties relative to other countries. Israel behaves badly on plenty of occasions, but so do other countries with far less complex challenges, and yet a visitor from another planet encountering Earth for the first time would lump Israel together with North Korea based on the media coverage (and if you think that is a fair comparison, please just stop reading now since you’ll be wasting your time). Israel always starts off in any situation at a complete disadvantage, and this is something that no other country deals with on a similar scale. Yet, this does not mean that Israel is a completely blameless actor in every instance, and none of the above obviates the fact that not all criticism of the Netanyahu government is a result of anti-Semitism, anti-Zionism, dislike of Netanyahu personally, or driven by a hidden agenda. To take the case in point, Netanyahu’s actions since last Thursday are not only childish and puerile, they are weakening Israel to an immeasurable degree.

Let’s zoom out for a minute and look at the long term picture. Israel is now perhaps more isolated than it has ever been on a number of levels, and certainly the most isolated it has been since 1975 during the Arab oil boycotts and the falling out with the Ford administration. Looking at Israel’s traditional regional allies, Israel’s relationship with Turkey is at an all-time low, its ties with Egypt are the most strained they have been in the post-Camp David era, and Jordan is too preoccupied with its own internal problems and the wave of refugees coming over the border from Syria to give Israel much cover on anything. While Israel does not have to worry about military threats from Arab states, it is looking at a long-term stream of diplomatic pressure from Islamist governments and less cooperation from Arab states on repressing non-state actors who threaten Israel.

In Europe, Israel faces an uphill battle as well. There is generally a lot of sympathy in European capitals for the Palestinians, but Europe’s indignation over settlements is real as well. This was driven home by the lopsided UN vote on Palestinian statehood, in which the Czech Republic was the only European country to vote with Israel. New allies Cyprus and Greece, to whom Israel has pinned such high hopes, both voted to grant Palestine non-member state observer status, and stalwart Israeli ally Germany abstained due to its anger over repeatedly being dismissed by Israel over the issue of settlement expansion. This all comes on the heels of the surprising European support for Operation Pillar of Cloud, which indicates that while Israel faces a tough audience in Europe, it has some wiggle room.

Then there is the United States, which has given Israel military aid for Iron Dome, constantly goes to bat for it in the UN including last week, was unwavering in its rhetorical support during military operations in Gaza, and also has been pleading with Israel to halt settlement expansion. The U.S. is unlikely to put heat on Israel like Europe does, but it has repeatedly expressed its displeasure with settlements and is very clear that it sees settlement growth as an obstacle to peace.

Given all of this, what is Israel’s most sensible course of action? Is it to loudly announce that it is going to “punish” the Palestinians for going to the UN by building thousands of more homes in the West Bank? Or is it to look at the big picture, realize that settlements are not just an excuse trotted out by anti-Semitic Europeans and Israel-hating leftists but are actually causing Israel all sorts of problems, and come up with some other way to deal with what it views as Palestinian intransigence? Israel went in the span of weeks from being viewed sympathetically due to Palestinian rockets indiscriminately targeting Israeli civilians to being denounced and having its ambassadors hauled in on the carpet over settlement expansion and being threatened with all sorts of countermeasures by the West. Please, someone make a cogent argument for me how this is somehow a brilliant strategy and how Netanyahu is ensuring Israel’s future existence, because from where I am sitting it is counterproductive, dangerous, and unwaveringly stupid. It’s all fine and good to constantly claim that Western views don’t matter and that Israel has the right to do what it wants, but that is the equivalent to burying your head in the sand. The fact is that Israel cannot exist on its own, it needs allies given the neighborhood in which it lives, and settlements are actually a problem for Israel’s allies. That’s the truth, and pretending otherwise is fiddling while Rome burns.

It has become clear to me over the past few years that contrary to the popular myth that the problems between Israel and the Palestinians stem from 1967, the parties are still fighting over 1948. Significant segments of Palestinians, with Hamas leading the way, simply will not concede the legitimacy of Israel, plain and simple. Concurrently, the constant refrains from the right about Palestinians not needing a state of their own because they have Jordan or the tired old canard that there is no land to give back to the Palestinians because it belonged to Jordan and to Egypt (always smugly spouted as if this is some brilliantly clever argument) is a vestige of 1948. Everyone loves to point out that Hamas doesn’t care about settlements, and that the PLO was founded in 1964, and both of these things are true and speak to the challenges that Israel faces that have absolutely nothing to do with settlements. But – and this a big one – settlements exacerbate the situation enormously, particularly with Western countries. Even ceding the argument that Palestinians of all stripes are never going to accept Israel in the pre-1967 borders and that Arab states will never want to make peace with Israel, Israel should then be doing everything it can to make sure it has the West on its side. You want to know what the best way to foul that up is? Proudly declaring that you don’t care what anyone else thinks and that you are going to build settlements wherever and whenever you like, and that doing so is not in any way an obstacle to a two-state solution and that in fact the blame rests solely with the other side. I am sick and tired of watching Israel’s supporters, of whom I am most definitely one, ignore the glaringly obvious facts that are right in front of their faces. Settlements are a huge problem, case closed. If you think that the benefit to expanding Israel’s presence in the West Bank outweighs everything else, then I respect your argument and at least you are going into this with eyes wide open. Pretending that settlements are an ancillary side issue though is willful blindness, and if that’s what you really think, then your powers of observation and analysis are sorely lacking.

How Will Romney’s Israel Policy Differ From Obama’s?

With Mitt Romney visiting Israel this weekend and giving speeches and making statements about his policy toward Israel, it seems like a good time to think about how his approach as president would be different from what we have seen under President Obama. Romney’s Jewish supporters, noting that a significant number of American Jews appear to be uncomfortable or disappointed with the way that Obama has interacted with Israel, have been pushing the notion that there will be a sea change if Romney is in office, and Romney himself has played up this idea as well. So, if Romney is sitting in the Oval Office come January 20, what can we expect to change?

The first big issue is military and intelligence cooperation and assistance, and almost nobody disputes the fact that these are at an all time high under Obama. Whether it be funding for Iron Dome, coordination on Stuxnet and other measures meant to disrupt the Iranian nuclear program, or the sale of advanced weaponry, Israel and the U.S. enjoy a closer relationship now than at any other time in the last 60 years. Indeed, last year Ehud Barak remarked, “I can hardly remember a better period of support, American support and backing and cooperation and similar strategic understanding of events around us than what we have right now.” This type of cooperation is sure to continue should Romney win in November.

Another big policy area is the peace process. Despite concerns over whether Romney supports a two state solution, which largely stem from the backing he is receiving from Palestinian state opponent Sheldon Adelson, I find it difficult to imagine that Romney will buck the strong bipartisan consensus and actually come out in favor of the rightwing one state solution favored by Joe Walsh and Danny Danon. Bibi Netanyahu himself is on record as being in favor of a Palestinian state, and even if you think this is mere lip service, it demonstrates just how far outside the mainstream abandoning the two state solution would place Romney. On the issue of whether he would push the Israelis on settlements and making concessions to the Palestinians, my guess is that Romney will occupy the same position as George W. Bush, which is to have an official policy against continued Israeli settlement expansion but to do nothing about it in practice. Obama famously pushed the Israelis on the issue of settlements earlier in his term, but has since backed off either due to a realization that his initial strategy was a bad one or in order to calm Jewish voters who were uncomfortable with his pressuring Israel but not the Palestinians, or perhaps a little bit of both. Whatever the case, Romney will likely not make the peace process a priority, but it is an open question as to whether a second term Obama would make a strong effort to force the two parties into a peace deal, and my own view is that he is going to let it drop. Between getting burned once and announcing a pivot toward Asia, I think that Obama’s heavy involvement in the peace process is a thing of the past.

Romney’s visit to Israel raised two other issues of American policy after he issued statements addressing each, and these are American support for a unilateral Israeli strike on Iran and moving the U.S. embassy from Tel Aviv to Jerusalem. On the Iran issue, there was initially some confusion as to whether Romney would commit U.S. troops after the fact were Israel to strike Iran, but Romney himself made clear in an interview in Ha’aretz that he and Obama hold the same position on Iran, saying, “President Obama has said that a nuclear Iran is unacceptable. I feel a nuclear Iran is unacceptable. The term ‘unacceptable’ continues to have a meaning: It suggests that all options will be employed to prevent that outcome.” While Romney has criticized Obama over his Iran policy and suggested that he would be more forceful with the Iranian regime, his actual policy is identical when it comes to tactics – namely, increased sanctions and keeping the military option on the table. Where the two men differ is over what constitutes the precise red line; for Obama it is Iran developing a nuclear weapon, while for Romney it is the attainment of nuclear capability.

Another place where Romney drew a clear distinction with Obama over the past two days was on the embassy question, but it is the emptiest of distinctions. Like George W. Bush and Bill Clinton before him, Romney pledged to move the American embassy to Jerusalem, and like Bush and Clinton before him, it is a virtual guarantee that should Romney be elected the embassy will remain right where it is. Since Jerusalem’s status is an issue to be negotiated under an Israeli-Palestinian peace agreement, no American government will actually move the embassy to Jerusalem so as to not act in a prejudicial way. Anyone who thinks otherwise simply knows very little about the politics of Israel in the U.S., and Romney himself knows full well that calling for the embassy to be moved is low hanging political fruit that will never see the light of day once he is in office.

Romney famously said earlier this year that he would do the opposite of what Obama has done on Israel, but this will plainly not be the case. When it comes to hard policy, the differences between the two men are negligible at best. The one place where Romney may differ from Obama is that, as pointed out in this excellent Aaron David Miller column, Obama does not seem to connect with Israel on an emotional level and this impacts the way he speaks about it and the way American Jews perceive Obama on the issue. Romney will not have this same problem, and while I think that looking at actual policies is the best way to judge the two on the Israel question, I understand the concerns that some Jewish voters have when it comes to Obama’s rhetoric. This divide on how one views Obama on Israel was captured in an instructive Twitter exchange yesterday between CFR’s Steven Cook (who is a friend and recent co-author) and Emergency Committee For Israel executive director Noah Pollak. After Pollak referenced “Obama’s abuse of Israel,” Steven queried how Iron Dome, Stuxnet, sanctions on Iran, and ensuring Israel’s qualitative military edge could be considered abuse. Pollak’s response was, “Diplomatic ambushes, tirade @ UNSC, joining HRC, WH snubs, going nuclear on settlements, isolating Isr to please Erdogan.” The bottom line here is that Obama supporters are convinced that he could not possibly be any more pro-Israel, and Romney supporters are convinced that Obama is anything but and that a President Romney would usher in a massive shift in Israel policy. From where I am standing, it seems pretty clear that, rhetoric aside, there is little daylight between the two when it comes to actual policies on Israel with the limited exception of what threshold will trigger military action against Iran, and that no matter who our next president is, we are bound to have almost complete continuity on policy toward Israel.

Dani Dayan’s Terrifyingly Transparent Op-Ed

I had planned to write about something else today, but Yesha chairman Dani Dayan’s op-ed in the New York Times requires a comment or a thousand (be forewarned, this post is on the longer side). Dayan has written a good summation of the settler leadership’s views, and it is instructive in that it does not attempt in any way to hide the ball but also rests on a series of false assumptions and logical inconsistencies. I thought I’d go through it paragraph by paragraph, since there is a lot in here to unpack.

Whatever word you use to describe Israel’s 1967 acquisition of Judea and Samaria — commonly referred to as the West Bank in these pages — will not change the historical facts. Arabs called for Israel’s annihilation in 1967, and Israel legitimately seized the disputed territories of Judea and Samaria in self-defense. Israel’s moral claim to these territories, and the right of Israelis to call them home today, is therefore unassailable. Giving up this land in the name of a hallowed two-state solution would mean rewarding those who’ve historically sought to destroy Israel, a manifestly immoral outcome.

To begin with, you almost have to admire the fealty to terminology. You will never catch Dayan referring to the West Bank as anything but Judea and Samaria (Yehuda and Shomron in Hebrew), and much like Peter Beinart with his call to rename the West Bank “non-democratic Israel” Dayan seems to think that the term West Bank is somehow an ideologically loaded one. I disagree, but it is a good peek into Dayan and the settler leadership’s mindset that they think calling the West Bank by its biblical name is somehow going to change people’s minds, as if it is simply a matter of psychological trickery. The other interesting thing to note is the bait and switch between the Arab armies seeking to destroy Israel in 1967 and the Palestinians to whom the West Bank would be given. There is no question that Hamas has “historically sought to destroy Israel” but the implication is that yielding the West Bank would reward the losers of the Six Day War, which is not the case.

Of course, just because a policy is morally justified doesn’t mean it’s wise. However, our four-decade-long settlement endeavor is both. The insertion of an independent Palestinian state between Israel and Jordan would be a recipe for disaster.

The influx of hundreds of thousands of Palestinian refugees from Syria, Lebanon, Jordan and elsewhere would convert the new state into a hotbed of extremism. And any peace agreement would collapse the moment Hamas inevitably took power by ballot or by gun. Israel would then be forced to recapture the area, only to find a much larger Arab population living there.

Moreover, the Palestinians have repeatedly refused to implement a negotiated two-state solution. The American government and its European allies should abandon this failed formula once and for all and accept that the Jewish residents of Judea and Samaria are not going anywhere.

This is where Dayan begins his strategy of appealing to security and political reasons not to give up the West Bank rather than making arguments about moral and historical justifications. I suspect he is doing this because he knows the latter arguments will not be winning ones with this particular audience, but his case is built on some contentious assumptions. First, the notion that Palestinian refugees are universally extremist is not a given, and the idea that Hamas will “inevitably” take power is also not assured. A Palestinian state in the West Bank that emerges following negotiations with Israel will be accompanied with massive international financial and security assistance to the Palestinian Authority, and a Hamas takeover is not a fait accompli, as Dayan would have it. Furthermore, Hamas already does control Gaza, and Israel has not been forced to recapture the area despite the problems that Hamas rule in Gaza has presented, so again we have a logical leap here that is presented as fact. Finally, it is true that the Palestinians have repeatedly turned down Israeli offers for a two-state solution, but Israel has not been entirely blameless in this process and Dayan rejects the very premise of a Palestinian state on the West Bank anyway, so this point is not at all relevant to his argument.

On the contrary, we aim to expand the existing Jewish settlements in Judea and Samaria, and create new ones. This is not — as it is often portrayed — a theological adventure but is rather a combination of inalienable rights and realpolitik.

This is what I mean about not trying to hide the ball. Dayan is extremely forthright about what he and the settlers for whom he speaks want, and I think his honesty in talking to a non-Israel audience is a good thing for which he should be commended. There is way too much dissembling on all sides when it comes to settlements, the peace process, and accepting Israel’s right to exist, so clear and open statements are welcome. The more noteworthy point here is that Dayan is claiming that settlement growth is a matter of rights and practical considerations rather than theology, and this is where he is not being entirely honest, as we shall see below.

Even now, and despite the severe constraints imposed by international pressure, more than 350,000 Israelis live in Judea and Samaria. With an annual growth rate of 5 percent, we can expect to reach 400,000 by 2014 — and that excludes the almost 200,000 Israelis living in Jerusalem’s newer neighborhoods. Taking Jerusalem into account, about 1 in every 10 Israeli Jews resides beyond the 1967 border. Approximately 160,000 Jews live in communities outside the settlement blocs that proponents of the two-state solution believe could be easily incorporated into Israel. But uprooting them would be exponentially more difficult than the evacuation of the Gaza Strip’s 8,000 settlers in 2005.

The attempts by members of the Israeli left to induce Israelis to abandon their homes in Judea and Samaria by offering them monetary compensation are pathetic. This checkbook policy has failed in the past, as it will in the future. In the areas targeted for evacuation most of us are ideologically motivated and do not live here for economic reasons. Property prices in the area are steep and settlers who want to relocate could sell their property on the free market. But they do not.

So now I am confused – are settlers motivated by material self interest or are they motivated by ideology? The explosion in the settler population has largely been fueled by the rising cost of living in Israel’s cities and the economic incentives provided by the government t0 move to the settlements, but Dayan does not mention that here. He then says that the 160,000 settlers living in areas not envisioned to be incorporated into Israel following a peace deal are ideologically motivated – read: theologically motivated – so despite his claim in the previous paragraph about rights and realpolitik, it now appears is if the issue is something else entirely, which is a religious attachment to the land. I understand and empathize with this position, but let’s then drop the charade that this about Israel’s strategic interests.

Our presence in all of Judea and Samaria — not just in the so-called settlement blocs — is an irreversible fact. Trying to stop settlement expansion is futile, and neglecting this fact in diplomatic talks will not change the reality on the ground; it only makes the negotiations more likely to fail.

Given the irreversibility of the huge Israeli civilian presence in Judea and Samaria and continuing Palestinian rejectionism, Western governments must reassess their approach to resolving the Israeli-Palestinian conflict. They should acknowledge that no final-status solution is imminent. And consequently, instead of lamenting that the status quo is not sustainable, the international community should work together with the parties to improve it where possible and make it more viable.

This is bound to infuriate those who have been warning for the past decade about Israel creating facts on the ground in order to impede the possibility of a Palestinian state, and it also demonstrates why the Palestinian insistence on preconditions to negotiating has been such an unmitigated disaster. It also gives a good window into the emerging support on the right for a one-state solution, and what is so fascinating here is that Dayan is writing as if he thinks that there an actual possibility that Western governments will simply back off and watch Israel turn the current status quo into a permanent annexation of the West Bank. If you want evidence of the horrible miscalculation and naivete of the settler right, led by Dayan and MKs like Danny Danon, look no further.

Today, security — the ultimate precondition for everything — prevails. Neither Jews nor Palestinians are threatened by en masse eviction; the economies are thriving; a new Palestinian city, Rawabi, is being built north of Ramallah; Jewish communities are growing; checkpoints are being removed; and tourists of all nationalities are again visiting Bethlehem and Shiloh.

While the status quo is not anyone’s ideal, it is immeasurably better than any other feasible alternative. And there is room for improvement. Checkpoints are a necessity only if terror exists; otherwise, there should be full freedom of movement. And the fact that the great-grandchildren of the original Palestinian refugees still live in squalid camps after 64 years is a disgrace that should be corrected by improving their living conditions.

 What a nice rosy portrait of the West Bank. Somehow, I doubt that most of its Palestinian residents would agree with it. Dayan is also pushing the conviction of the settler right that as long as Palestinians in the West Bank have good living conditions and increased economic opportunities they won’t care about having political rights. This is practically wrong and morally wrong, and the fact that Arab countries have treated Palestinians in a detestable manner does not obviate Israel’s obligation to do better. If Dayan and his political allies actually think that they can get away with annexing the West Bank while preventing Palestinians from enjoying the same political rights as Israelis, they are going to be in for a very rude awakening as they drive Israel right off a cliff.

Yossi Beilin, a left-wing former Israeli minister, wrote a telling article a few months ago. A veteran American diplomat touring the area had told Mr. Beilin he’d left frightened because he found everyone — Israel, the Palestinian Authority, Jordan and Saudi Arabia — content with the current situation. Mr. Beilin finds this widespread satisfaction disturbing, too.

I think it is wonderful news. If the international community relinquished its vain attempts to attain the unattainable two-state solution, and replaced them with intense efforts to improve and maintain the current reality on the ground, it would be even better. The settlements of Judea and Samaria are not the problem — they are part of the solution.

There are many problems with this type of thinking, but one of the biggest is that the world is not static. Just because the West Bank is quiet now does not mean that it will be so forever. The first intifada took Israel by surprise, and then the second one was even more challenging and violent than the first. There is little doubt that the third one – and make no mistake, a third intifada is going to happen at some point – will be even worse than the previous two, at which point Dayan’s conclusion goes up in smoke.

The emergence of real support for a rightwing one-state solution is terrifying to me, and Dayan’s op-ed crystallizes in concise form why it is happening. The settlement movement is busy convincing itself that settlements have become permanent and immovable, and nothing that the Netanyahu government has done, from commissioning the Levy Report to the continuing efforts to push off the High Court’s order to evacuate Migron, have disabused them of that notion. More dangerously, the settler leadership is also convincing itself that Israel will be able to get away with a binational state. The Israeli public desperately needs to be convinced that this is a problem that cannot be ignored, because most Israelis are not going to like what happens if this outcome actually emerges, and unfortunately the far right seems to be the best motivated party at the moment. Dayan’s piece needs to be a wakeup call, since it is nakedly transparent on what the settlers want to accomplish while also being dangerously naive and shortsighted about what will happen if they are successful.

Thinking Strategically on Settlements

Shimon Peres gave a speech this week in which he warned about the danger that settlements pose to Israel’s Jewish majority. He spoke about a “threatening demographic change” and pointed out that without a Jewish majority, Israel will cease to be a Jewish state. This prompted predictable outrage from the right, with Yesha head Dani Dayan inveighing that the only danger to the Jewish state is conceding the right to the West Bank and 350 rabbis sending Peres a letter in which they said he should beg for forgiveness for the peace process and criticized his “hallucinatory ideas.” Peres’s speech also, however, brought opprobrium from the left, as various people were upset that Peres framed the problem with settlements as a strategic problem rather than an ethical or moral one. In this view, the primary problem with the settlements is that they are furthering the occupation and preventing a Palestinian state, and thus the argument against them should be that Israel is perpetrating an unethical policy in the West Bank and settlements should be denounced primarily as conflicting with the value of a democratic state and a Jewish state.

I am sympathetic to this argument, but it ignores the politics of the situation and misses the long view. The left and center-left do not need any convincing on the need for Israel to abandon the settlement enterprise outside of the major settlement blocs that Israel will presumably keep in a peace deal. If there is to ever be real movement on this issue, it is the right that needs to be brought around, and arguments about Palestinian rights are unlikely to be convincing. I do not mean to suggest that everybody on the right is completely unconcerned with the status of the Palestinians on the West Bank, but this has historically not been a winning argument on the right. If the right is to be swayed, it will be by arguments about Israel’s security and future, and in that sense, the demographic argument is the only one in town. I’ve heard that people in the upper ranks of the government don’t take the demographic threat seriously and believe that time is actually on Israel’s side, and I have had similar impressions in talking to friends and colleagues who are more rightwing on Israel issues than I am. When I was in Turkey two years ago, I got into what turned into a heated discussion with an older American Jewish couple whom I met while their cruise ship was docked in Istanbul for the weekend. During a conversation about Israel where I brought up the argument that Israel was running out of time to separate from the West Bank, the wife heatedly insisted that I had no idea what I was talking about because her daughter lives in Israel and has five kids, and so she absolutely refuses to believe that in 20 years there will be just as many Palestinians in Israel and the West Bank as there are Jews. The only way to convince rightwingers and conservatives that settlements need to be dealt with is to keep on pushing the demographic argument and make people realize that every day that passes increases the possibility of a binational one state Israeli future. This is why Peres’s speech was the correct response to the Levy Report, and while it might make folks on the left upset, a little more strategic thinking on this issue is required.

On a similar note, this is why I think that the Levy Report is so dangerous and why I disagree with Brent Sasley’s argument that Levy does not represent anything new. Has Israel been extending its control over the West Bank? Yes, it has. But that doesn’t mean that the Levy Report is not a dangerous development, because by legally eviscerating the line between Tel Aviv in Israel proper and Efrat over the Green Line, and between authorized settlement bloc Ariel and unauthorized outpost Migron, it brings a one state solution ever closer (for those whose Hebrew is less than stellar, Elder of Ziyon has a useful translation of the legal reasoning section of the Levy Report). The report’s significance is not in what it signals about past Israeli intention in the West Bank, but in what it signals about Israel’s political future and survival as a Jewish state. Brent and others think that the report is simply more of the same and that the declaration that there is no occupation is just the Israeli right showing its true colors in a more public manner, but this loses sight of the fact that Levy represents the opening salvo in the growing calls for a rightwing one state solution. Quite simply, this will be the end of Israel as we know it, and the right needs to be convinced that this is a path to oblivion. If this requires hammering away at the demographic argument and dropping language steeped in morality and ethics, so be it. Peres is on to the right idea here, and people on the left and the center should start thinking along these lines as well.
