The Perfect and the Good

Labor leader Buji Herzog did something unusual this week for a man who leads Israel’s traditionally largest party on the left. He got the party of Yitzhak Rabin and Oslo, of Ehud Barak and Camp David, to temporarily throw in the towel on the peace process and negotiations, and to embrace unilateral separation from the Palestinians instead. Herzog’s plan calls for Israel to freeze all building outside the settlement blocs, retain the blocs, and complete the security fence in order to establish a provisional border; convert parts of Area C to Area B, thereby transferring administrative control to the Palestinian Authority; and separating Palestinian neighborhoods of East Jerusalem from the Jerusalem municipality. The plan is predicated on the principle that a two-state vision is currently impossible to implement under the framework of permanent status negotiations, and that the only path forward is to preserve the two-state vision while doing everything possible to separate from the Palestinians until the environment is more conducive to negotiations. As someone who wrote with Jordan Hirsch in Foreign Affairs in August 2014 that Israel should unilaterally pull out of the West Bank and kill the peace process in order to save the two-state solution, Herzog’s general approach here is one that I favor.

But the plan has many vocal critics who raise valid concerns. Within Labor itself, former Labor leader Shelley Yachimovich has come out against it and is likely to use opposition to the plan as a springboard to challenge Herzog for the party leadership. While Yachimovich is motivated as much by politics as anything else, other critics on the left have pointed to specific aspects of the plan that they contend will cut off Palestinians from the Old City of Jerusalem, or make it harder for the Palestinians to get the land swaps they want in return for Israel annexing the blocs, or doom the two-state solution by abandoning it and empowering the current government. What much of this boils down to is opposition to Herzog’s attempts at triangulation; ditching the formula of permanent status negotiations, which is the only way of arriving at a fair and equitable solution for all sides, in favor of a stopgap strategy that will make some things better and other things worse but certainly prioritize Israel’s interests at the Palestinians’ expense.

These arguments carry a lot of weight. Any temporary measure that ends up making the situation in Jerusalem worse or turns into a permanent land grab is ultimately not sustainable. Nevertheless, I think Herzog’s measure can theoretically be a good initial step if it is done right. In order to do it right, it will also have to incorporate three Ds – define, develop, and defend. Without these, its critics are correct that it will only establish facts on the ground without moving the two sides closer to a sustainable and permanent solution.

Any plan that effectively prioritizes the settlement blocs while freezing settlement activity outside of them can only work if the blocs are defined. Everyone throws the term “blocs” around as if they constitute an agreed-upon area, but it means different things to different people. The blocs that Israel will keep in any permanent status negotiation need to be identified definitively; for instance, including the Etzion bloc as part of Israel is an easy one, but Ariel juts much farther out into the West Bank, so does a settlement freeze outside the blocs include or exclude Ariel? Furthermore, once it is settled just which blocs we are talking about, the precise borders of each bloc need to be delineated so that they don’t keep on expanding and swallow up more of the land that will go to an eventual Palestinian state. Without defining the blocs, calling for a settlement freeze outside of them is an empty gesture.

Separating from the Palestinians without a plan to develop the West Bank is another necessary condition for the success of a unilateral strategy. Herzog hints at this through his recommendation to enlarge Area B at the expense of Area C, but it can’t simply be foisting more responsibility on the Palestinian Authority and then dusting off your hands. It must also include exponential expansion of the building permits granted to Palestinians in Area C – of which only one was granted in all of 2014 – while eliminating the absurd amounts of red tape that cause goods for Palestinian towns to languish in Israeli ports (such as pipes for the new reservoir that is supposed to supply Bethlehem with water). Without building up the West Bank economy and actually giving it a chance to flourish, separation will do nothing but create a boiling cauldron on the Palestinian side of the fence.

Finally and most crucially, for any unilateral separation to eventually result in a genuine two-state outcome, defense of Israel and security issues must be addressed. The reason that Bibi Netanyahu wins election after election is because, irrespective of anything else that goes on, he has his pulse on Israelis’ psyches and the genuine fear that has dominated Israeli life since the Second Intifada. Israelis are not willing to play games with security, and no Israeli government will ever be party to the creation of a Palestinian state unless and until Israelis feel assured that the West Bank will not present a permanent security threat. This means that if unilateral separation is supposed to move Israel toward two states while waiting for a more opportune moment to resume negotiations – and I don’t doubt that this is Herzog’s wish and intention – then there must be continued coordination with the PA security forces, a robust plan for how to secure the Jordan Valley, and a mechanism for correcting the currently wholly inadequate Palestinian police coverage in Areas A and B. Defending Israelis’ daily security and providing them with a sense of calm in the aftermath of any unilateral separation is the only way to build enough trust in laying the groundwork on the Israeli side for a negotiated solution in the future.

When thinking about two states, a common mistake is to conflate the peace process with the two-state solution. Tom Friedman committed this cardinal error just yesterday, writing that because the peace process is dead, the two-state solution dies with it. They aren’t the same thing. The peace process is the perfect ideal, while the two-state solution is a good result. Any viable plan has to take the politics of the moment into account, and the politics of the moment clearly dictate that pushing negotiations on two unwilling parties is an unmitigated disaster. One can take the Netanyahu approach, which is to sit on one’s hands and do nothing, or one can try to advance an alternative that is highly suboptimal but that beats the status quo. I would rather see the latter option be tried rather than continuing to sacrifice the good on the altar of the perfect.

Liberal Jews Without Liberal Organizations

Why are American Jewish organizations predominantly silent on Israeli illiberalism? This is the question posed and answered by J.J. Goldberg in a much-discussed piece this week on Martin Luther King Day tying the American Jewish organizational voice on Israel to the breakdown of the black-Jewish partnership on civil rights. Goldberg’s theory quickly summed up – and you should really read the piece in its entirety if you haven’t yet – is that the biggest factor in how American Jewish organizations relate to Israel today is the collapse fifty years ago of the alliance between blacks and Jews on civil rights. As black activists increasingly called for blacks to fight for their civil rights by themselves, and as Jews got to a point where their own equality seemed secure, Jewish organizations that were built to fight for civil rights needed another battleground. This coincided with the Six Day War, which imparted the lesson that Israel was living in a neighborhood where its neighbors wanted it gone and could be wiped out at any time, and American Jewish organizations thus pivoted to devoting their time to supporting Israel as their primary mission. Despite the liberal bent of American Jews, they are passive on the Israel issue because they learned to live without a collective voice that was connected to group self-interest.

There is a lot to mull over in Goldberg’s piece and many typically keen insights. He makes a strong historical argument, but as strong as that argument is, I am not sure that the fracture in the civil rights movement is what is primarily driving today’s dynamic. To begin with, Goldberg rightly points out a number of organizations that do not fit into this picture of checking their liberalism at the door when it comes to Israel, and their number is not insignificant. Furthermore, the three most prominent Jewish organizations that were involved in the civil rights movement were the American Jewish Committee, the American Jewish Congress, and the Anti-Defamation League. The American Jewish Congress has all but folded and the ADL is one of the organizations that Goldberg identifies in his piece as not being afraid to speak out on Israel today, so the historical institutionalist argument that he sketches doesn’t appear to apply in scale to the organizations operating today. In addition, the organization that most people would point to as driving the American Jewish organizational stance on Israel is AIPAC, which does not fit into Goldberg’s theory.

I would instead point to two other variables that I believe are causing the dissonance between a very liberal American Jewry and a far less liberal American Jewish organizational stance toward Israel. The first fits into the structure of Goldberg’s overall argument about a crisis in mission leading to a new focus on Israel, but rather than point to civil rights, I would point to the decline of Judaism itself. As traditional religious observance waned over the course of the 20th century, Israel was elevated into a religious cause that became for many American Jews their primary way of expressing their Judaism as a religion, as opposed to their embrace of Judaism as an ethnicity or a culture. Support for the Jewish state became de rigeur at synagogues of all denominations, prayers for the Israeli government and the IDF were adopted into the Shabbat morning liturgy, and Israel itself became intertwined with Judaism so that it became a focal point of the American Jewish religious tradition. Support for Israel was the equivalent of fasting on Yom Kippur or holding a Passover seder; even if your religious observance was minimal, Israel was a part of it. For many American Jews, Israel was what bound them to Judaism, rather than the religious practices of their parents and grandparents. For Jewish organizations that needed to stay relevant, pivoting to supporting Israel was an obvious move, and naturally any organization devoted to advocating for something is going to be reluctant to be overly critical, even when there are things taking place that are particularly unpalatable.

The second variable is political trends in Israel. In the twenty years since the assassination of Yitzhak Rabin, Israelis have only once voted a left of center prime minister into office, and Ehud Barak did not last even two years. Going back even further to the 1977 election of Menachem Begin, which marked a revolutionary shift in the Israeli political landscape, Rabin’s election in 1992 was the only other time since then that Israelis have voted a Labor prime minister into office (Shimon Peres’s first term in 1984 was part of a rotation agreement with Yitzhak Shamir and Likud). In other words, for nearly four decades Israelis have displayed a clear rightwing preference when it comes to their leaders. Is it any surprise then that American Jewish organizations, both those that deal primarily with Israel issues and those that don’t, take those cues and reflect what is taking place in Israel itself?

This is not, incidentally, applicable only when a rightwing government is in power in Israel. When Rabin began the Oslo process, AIPAC did in fact support it, even if begrudgingly. The major American Jewish organizations that now seemingly fall in lockstep behind the Netanyahu government were not out front challenging the Rabin government on its priorities, even though he represented a major break from the previous fifteen years of Israeli government policy. It would be fascinating to see what American Jewish organizations would look like with regard to Israel policy were Israel to spend an uninterrupted decade under the control of left of center governments; my instinct is that American Jewish organizations are shaped by the structural environment of Israeli politics in a significant way and would presumably change with the times.

There is no question that the priorities of the bulk of American Jews appear out of sync with the priorities of many American Jewish groups. I think that Goldberg is definitely onto something in looking back at historical trends and moments that shape today’s environment, but I would point to a different set than the ones that he has identified.

Unholy Fire on the Temple Mount

As terrorist attacks on Israeli civilians proliferate across Jerusalem and other Israeli cities, everyone seems to be hoping that a combination of a greater Israeli military and police presence on the streets and the Palestinian Authority holding the line on larger organized attacks will prevent further violence. While everyone recognizes that there are no perfect solutions, the nature of this nascent uprising is more dangerous than those that have come before because of the fusion of political nationalism and religious nationalism. The Temple Mount has always been in the background imagery of the Israeli-Palestinian conflict, but now it is front and center and it does not bode well for what is to come.

The PA is largely impotent here because the attacks are being carried out by Palestinians from East Jerusalem, who are not under the PA’s jurisdiction, and the primary motivation is the most dangerous one of all, which is a perceived threat to Muslim dominance of the Temple Mount. Palestinians (and Jordanians, and the Arab League, and the Turkish government) accuse Israel of altering the status quo on the Temple Mount, and Abbas, the PA, Hamas, the Islamic Movement in Israel, Joint List Arab MKs, and nearly every other actor on the Palestinian side are whipping the Palestinian public into a frenzy over the issue. Because the status quo is an unwritten agreement and because the margins of what precisely it means have shifted over time, there is no consensus as to what precisely it entails, but the basic parameters are solely Muslim prayer on the Temple Mount and some form of access to the Mount for non-Muslims so long as prayer is not involved. From a technical standpoint, and in line with Prime Minister Netanyahu’s constant claims on the subject, the Israeli government has not altered the status quo, as it maintains an official policy of prohibiting Jews from praying on the Temple Mount. Indeed, Netanyahu has gone so far as to ban MKs from the site entirely so as not to risk a potentially explosive incident.

Nevertheless, Palestinians and Muslims worldwide refuse to believe that Israel is not in the midst of violating and attempting to alter the arrangement that has held since 1967. The reasons for this suspicion are that in the past half decade, and even more markedly this year, there have been increased Jewish visits and in larger numbers, along with visits from rightwing government ministers – Uri Ariel most prominent among them – who have prayed on the Mount and publicly demanded that the status quo be changed. This is part of a trend within religious Zionism to embrace the Temple Mount – as opposed to solely the Western Wall – as a site for prayer and a way of asserting Jewish nationalism in contrast to what was once a nearly universal religious prohibition from ascending to the Temple Mount plaza.

Given the involvement of government ministers in this changed dynamic and new restrictions on Muslim access to the Temple Mount during the High Holidays this year for security reasons, it is easy to understand why Palestinians are literally up in arms when their leaders demagogue about a mortal threat to Al-Aqsa. The fact that what Israel has given up in agreeing to this status quo – creating a blatantly discriminatory religious double standard against Jews at the holiest site in all of Judaism – or that by all objective accounts Netanyahu desperately does want to maintain the status quo seems not to matter. Also overlooked is that weapons and explosives were seized from Al-Aqsa by the Israeli police last month after having been stockpiled right under the noses of the Waqf in charge of administering the site, which seems to be quite the violation of the status quo given that weapons stockpiled atop the Temple Mount would almost certainly be used as part of a campaign to deny access to non-Muslims.

Despite the fact that the incitement taking place on social media is centered around the Temple Mount, that Abbas and other Palestinian leaders keep on raging about the Temple Mount, and that attackers who have been apprehended have given defending the Temple Mount as their primary motivation, some refuse to accept the reality of what is taking place. In a widely shared column in the Wall Street Journal, Bret Stephens characterized the wave of terrorist attacks as a Palestinian communal psychosis with no motivation behind it other than to kill Jews. Stephens is absolutely and unreservedly correct that knifing Israelis on the streets is indeed a psychotic and evil act and that there is no rational justification for it. But his dismissal of the Temple Mount status quo motivation wholesale because “Benjamin Netanyahu denies it and has barred Israeli politicians from visiting the site” rings a bit hollow, and not only because in the very next paragraph he quotes Abbas saying, “Al Aqsa Mosque is ours. They [Jews] have no right to defile it with their filthy feet.” It ignores the fact that irrespective of what Netanyahu has actually done to preserve the status quo – something that State Department spokesman John Kirby yesterday confirmed – the perception among Palestinians, including those killing and maiming Israelis, is very different.

Which brings me to the final point, which is the wider context beyond the Temple Mount. To deny the role of the occupation of the West Bank and the second class status of Palestinians in Jerusalem in all of this is to be willfully blind, just as blaming the occupation for this completely is to be dangerously naïve and enables more and uglier violence. There is a middle ground between “the occupation causes terrorism” and “terrorism isn’t related to the occupation at all” and it is vital to keep this in mind, as there are no easy answers or parsimonious narratives that can entirely account for the terrible events happening in Israel. Humans are complex animals and we are capable of processing complex thoughts. Incitement from Palestinian leaders and false claims about the Temple Mount and even outright murderous hatred of Jews may be the spark for the current violence, but it can also simultaneously be true that a nearly half-century long military occupation of the West Bank and blatant mistreatment of Arabs living in a supposedly undivided Jerusalem is the propane supply for the current explosion. To deny the lessons of history on the awesome and destructive power of nationalism and to not see it on display among Palestinians as their nationalist dreams go unrealized is to defy logic, even when there are other factors at play as well.

If there is one lesson to take away from all of this, it is that separation for Israel from the Palestinians is more important than ever, as this is only a taste of things to come. The current violence is being driven by Palestinian women, teenagers, and children who could not care less about the PA leadership, the Oslo Accords, or the PA’s desire to maintain some sense of quiet in order to preserve its own hold on the West Bank. While the PA security forces may be able to keep the lid on organized terror attacks planned by cells in the West Bank, the lone wolf and unorganized attacks taking place on Israeli streets are beyond its control. The disappearance of a sense of safety and security for Israelis during their daily routines illuminates the chimerical fantasy of a one-state solution and provides a glimpse into what ethnic strife in a bi-national state might look like. Terror cannot and should not be rewarded, but there also needs to be a greater sense of urgency to come up with a solution that will ameliorate this situation for good.

Diaspora Jews Are Not Israel’s ATM

The eminent Israeli political scientist Shlomo Avineri published a long essay in Ha’aretz last week arguing that the failure of Oslo can be attributed to the fact that Israel views the Israeli-Palestinian conflict as a struggle between two national movements while the Palestinians view it as a struggle against colonialism, explaining the inevitable failure of negotiations. The piece deserves a long response of its own as there is much to unpack, but Avineri published a companion op-ed yesterday arguing, among other things, that given how negotiations are doomed to fail, Israel should ask Diaspora Jews to shoulder the costs of relocating and compensating settlers inside the Green Line. I am very much on board with relocating and even compensating settlers in order to get them out of the West Bank as expeditiously as possible. It is the other part of this formulation with which I take issue. To quote Avineri directly:

One could initiate, possibly with the support of Diaspora Jews, a generous plan for evacuation and compensation for settlers in the West Bank who would be willing to return to Israel in its pre-1967 borders. The right in Israel has managed to recruit Jewish donors around the world for expansion of settlements and for purchasing land and buildings in East Jerusalem. Why can’t the left follow suit and mobilize moderate Diaspora Jews in order to achieve something concrete – not just declarative – in order to further alternative policies? Perhaps even J Street could help in achieving something positive, not just criticizing Israel’s policies?

In 2010, as a forest fire spread out from Mount Carmel and caused enormous devastation, the Jewish National Fund called on American Jews to donate money for firetrucks and basic fire fighting equipment. Jeff Goldberg wrote an excellent post pushing back on this campaign, asking “What sort of country — what sort of wealthy country — schnorrs for basic public safety equipment?  At some point, Israel is going to have to learn to stand on its own, and fund its national security and public safety needs without the help of Diaspora Jewry.” Goldberg’s point was that some causes are legitimate and just – such as schools and hospitals, or aiding the victims displaced by the fire – and others are Israel asking someone else to cover for its self-imposed mistakes, a category to which chronic underfunding of firefighting services most certainly belongs.

I couldn’t help but recall this episode when reading Avineri’s call for Jews around the world to bail Israel out of its predicament. I find his suggestion to be both morally and practically problematic and downright offensive. It speaks to the worst of Israeli instincts, and illuminates the crux of the divide between Israeli and Diaspora Jewry.

I believe that American Jews should support Israel to the extent that they believe strongly in the need for a Jewish state (which I certainly do), and that a strong and healthy Israel benefits not only Israelis but Jews worldwide. Nevertheless, there is a distinction between supporting Israel and Israeli Jews in need, particularly in the early days of the state when Israel was not in good economic shape, versus funneling money to a state that brands itself as the Start-Up Nation and boasts of its economic strength and innovation in order for it to disentangle itself from a set of self-imposed policy disasters. The former, which would include things such as JNF campaigns to plant trees, assist in resettling Ethiopian and Russian immigrants, and donating to victims of terror, are clear cut examples of supporting the Zionist vision. They involve building a Jewish homeland and helping Jewish brethren in need who have been placed in situations beyond their or the Israeli government’s control, and I have no problem at all with Israel turning to Diaspora communities to help support such initiatives.

In contrast, the latter is a clear cut example of American Jews being used as suckers. As it is (and you will excuse the simplified stereotype here), oftentimes Israelis view American Jews as little more than piggybanks who should provide money but keep their mouths shut. Asking Diaspora Jewry to provide the funding for an overtly political predetermined course of action only reinforces that corrosive dynamic, particularly given that Israel is an OECD country that ranks 19th on the UN’s Human Development Index and 25th in GDP per capita according to the World Bank and can more than afford to cover the costs of its own internal policy decisions. More saliently, asking non-Israeli Jews to shoulder the financial burden for the evacuation of the West Bank encourages the Israeli government to pursue bad policies such as settling the West Bank under the assumption that there will always be a safety net from American Jews who won’t abandon the state under any circumstances and will pay to reverse Israeli mistakes. It creates a dangerous moral hazard that incentivizes risky behavior, and perpetuates a culture of dependency on outsiders. It is a terrible idea that makes Israel look like a third world country and diminishes the vision of a strong and independent state.

Furthermore, there is a logic of unintended consequences involved that Avineri fails to consider. From my perspective, the support of rightwing American Jews in the settlement project has been an unmitigated disaster that has only perpetuated bad policies, and in some ways has even rendered the Israeli government impotent. There is little to prevent Sheldon Adelson or Irving Moskowitz from pursuing their own goals precisely because the Israeli right has relied on outside money, and a government that wanted to prevent further building in the West Bank or Silwan would have a difficult time shutting things down because funding is coming from other sources besides the government. Just because Avineri wants to gin up financial support from Diaspora Jews for a policy that is in my view a good one doesn’t make it a good idea. There is no predicting how these types of things develop down the line, and there are likely to be unforeseen consequences that arise. Introducing more outside funding into the equation in response to unhelpful outside funding on the other side isn’t going to balance the ledger, but will instead contribute to a further spiral out of control.

I agree with Avineri that Israel should be evacuating the West Bank and relocating settlers. I agree that marshaling the moral and rhetorical support of Diaspora Jews would hasten that along. But treating Diaspora Jews as dollar signs and watering down Israeli ownership of its own policies is an unwise suggestion.

A Glimmer of Light Through the Clouds

These are not auspicious times for supporters of two states. The generally despondent mood was captured by Chemi Shalev this week in a column where he declared the death of whatever remaining optimism to which he had been clinging, and resigned himself to Israelis and Palestinians never resolving their differences and continuously battling – a “war of the cowards” in his formulation. This comes on the heels of Mahmoud Abbas’s UNGA declaration that the Palestinian Authority no longer feels bound by the Oslo Accords and will pick and choose which elements it cooperates with; the mounting terrorist attacks targeting Israelis of all stripes and ages; the unrest wracking Jerusalem and its immediate environs; and the rumbling conflict and potential wider conflagration over the Temple Mount.

The most immediately pressing problem is the intifada that is taking place in Jerusalem, despite the reluctance of most politicians and other observers to call it what it is. There are multiple attacks and arrests taking place every day, too many incidents of rock throwing to catalogue, seizures of caches of weapons and firebombs, and entire neighborhoods in Jerusalem that are rapidly becoming battle zones. This does not even take into account what is going on in the West Bank, where attacks and arrests are both up as well, or the riot in Jaffa on Tuesday night. The intelligence and security forces have assured Prime Minister Netanyahu that there is no intifada yet, only a wave of increased violence, but this is a distinction without a difference that is based on an outdated fallacy. The fallacy is that an intifada can only erupt with the complicity of the Palestinian leadership, and since Abbas and the Palestinian Authority have been cracking down and trying to prevent the violence from spinning out of control, ipso facto there must not be an intifada.

This ignores a very basic lesson in political science, which is that just because something has always happened in one particular manner does not mean it is fated to always unfold the same way. Civil uprisings have a logic of their own, which is what makes them so difficult to predict. One of the main lessons of the inaptly termed Arab Spring is that Middle Eastern authoritarian governments –which the PA most certainly is – do not have absolute control over their subjects, and this is particularly the case for regimes that are already hampered by questions of legitimacy. Just because the first and second intifadas were encouraged and planned by the Palestinian leadership does not mean that the next one must take the same path. The PA does not have a monopoly on violence in the territory under its control, and nationalist entrepreneurs seeking to foment civil unrest for their own political goals will not necessarily heed the PA’s preferences or follow its lead. In addition, Palestinian politics is more fragmented than it was fifteen years ago, and Hamas and other even more extreme groups do not have the same incentive structure as the PA. Finally, given what we have seen from seemingly leaderless social movements around the globe over the course of this decade, expecting the PA to turn the intifada switch on or off at its discretion may be foolhardy.

Adding to the tension is that the current unrest is centered around Jerusalem and the Temple Mount. While the second intifada was set off following Ariel Sharon’s Temple Mount visit but was not driven by the Mount itself, the recent increase in violence is centered almost entirely around the Temple Mount and the allegation that Israel is attempting to alter the status quo that establishes the plaza as a site exclusively for Muslim prayer. Anything having to do with the Temple Mount is inevitably explosive given that it is a symbol simultaneously religious and nationalist for both sides, and the fact that actors who should know better – such as Abbas and King Abdullah of Jordan – are fanning the flames by making grossly exaggerated accusations about Israeli actions only furthers the prospects of violence spreading out of control.

It is not only the Palestinians or the Jordanians who are using attacks on Israelis to further their own political ends, but members of the Israeli government as well. The more hardline rightwingers in Netanyahu’s coalition, including ministers from Likud such as Haim Katz and Yariv Levin and Habayit Hayehudi ministers Naftali Bennett and Ayelet Shaked, have been agitating that Netanyahu needs to adopt harsher responses to terrorist attacks on Israelis, and some went so far as to demonstrate outside his house in protest of policies that the government in which they serve has adopted. Netanyahu batted them down earlier this week by implicitly threatening to disband the government should the friendly fire continue, but adding a dose of political unrest to the soaring civil unrest makes for a poisonous mix.

So what is the silver lining, if any, to be found in this doom and gloom? It is that Netanyahu is actually behaving like the reasonable adult in the room and doing his best to prevent the situation from spiraling further downward. Aside from appearing to finally understand the threat that expanded settlement activity poses to Israel internationally and continuing to enforce an unpublicized settlement freeze, Netanyahu is doing his best to actually maintain the status quo on the Temple Mount despite the enormous political pressure on him to establish new facts on the ground (and despite the inherent injustice of preventing Jewish prayer at Judaism’s holiest site). Furthermore, Netanyahu has ordered the police to ban all government ministers and MKs from the Temple Mount, an extraordinary step that speaks to how seriously he understands that there will be no capping the eruption should tensions over the site escalate.

Folks on the left and the center tend to come down hard on Netanyahu – and rightly so – when he does and says things for his own political gain that deepen Israel’s isolation or contribute to illiberal trends in Israeli politics and society, yet Abbas is often given a free pass due to the uncomfortable political situation in which he must operate. While the estimation of the Israeli security establishment is that Abbas is doing his best to tamp down the violence erupting throughout Jerusalem and the West Bank and that Israel is going to miss him enormously when he is gone, this is not the whole story. He certainly deserves credit for all positive steps, but the fact that he has his own political survival at stake should not inoculate him from criticism over fanning the flames on the Temple Mount, or refusing to condemn terrorist activity that can in no way be chalked up as legitimate political protest or civil disobedience or resistance against an occupying power. The Israeli occupation is not a trump card when it comes to irresponsible rhetoric that will inevitably lead to incitement or the murder of civilians, and holding Netanyahu to an exceedingly higher standard than Abbas is the soft bigotry of low expectations.

A rightwing Israeli prime minister who presides over the narrowest possible coalition in the Knesset and is under constant assault from those to his right, whose commitment to two states is in question, and who has spent decades caving to the most irredentist elements of his party and coalition, has now halted new settlement growth, banned elected officials from the Temple Mount in an effort to protect exclusive Muslim rights on the site, and has so far refrained from a large and public show of force in the West Bank in response to multiple firebomb attacks, shootings, and stonings, all in recognition of the fact that the volume must be turned down in a major way. While some of these actions may be less just than others (and the Temple Mount issue in particular is one that I will write about in depth next week), they all point to a prime minister putting pragmatism over politics for the moment. Shalev opens his otherwise depressing column by noting how anyone watching Anwar Sadat emerge from his plane at Ben Gurion Airport in November 1977 could not help but believe that miracles do happen, and that it showed how calamity could transform into opportunity. Let’s hope that Netanyahu’s new leaf demonstrates that history always holds open the possibility of new beginnings.

Why Avigdor Lieberman’s Resignation Really Matters

In an announcement that has long been anticipated, Israel’s attorney general yesterday said that Foreign Minister and Yisrael Beiteinu head Avigdor Lieberman will be indicted for fraud and breach of trust stemming from his efforts to help former ambassador to Belarus Ze’ev Ben Aryeh become ambassador to Latvia after Ben Aryeh leaked information to Lieberman about the government’s investigation into his dealings. While the breach of trust charge was not a surprise, the fraud charge was, and after saying that he was not going to resign, Lieberman just announced that he will be resigning as foreign minister although he remains as YB party chief and will be running in the elections on the joint Likud Beiteinu list.

When it looked like Lieberman was not going to resign yesterday, there was a lot of commentary on what the indictments would mean for him politically. Brent Sasley called the indictments a distraction and argued that it wouldn’t have much impact on the upcoming election or on Lieberman’s long term goal of eventually becoming prime minister, and I think this is right even after the news that he is stepping down from his cabinet post. Lieberman is still going to get a lot of votes for his party as part of the joint list with Likud, and I think he is also likely to return to his post as foreign minister, even possibly before the election should he work out a plea bargain in time. The short term impact of the indictment and resignation is going to be minimal, and for all of those hoping that Lieberman was going to disappear from public life, you are bound to be very disappointed. Nevertheless, there is an important way in which Lieberman’s indictment and his decision to (temporarily) vacate his FM post matters, but it isn’t about short term politics.

For much of Israel’s history, Israeli politics was dominated by great men who had accomplished substantial things. In some instances they were achievements to be proud of, such as Yitzhak Rabin commanding the IDF to victory in 1967 (at least when he wasn’t suffering a nervous breakdown) and then signing the Oslo Accords in 1993, and in other instances they were (to my mind, at least) not, such as decisions by multiple prime ministers to settle and then settle more the West Bank. Israeli leaders were known for their accomplishments, whether it be creating the institutions of the state, fighting wars against hostile enemies bent on Israel’s destruction, or carving out diplomatic space and cementing alliances. In some ways this was inevitable, as the founding fathers of any state are going to be more accomplished than those that come after them given the nature of the trial by fire that is involved. Yet, even the current generation of Israeli leaders includes seriously accomplished military officers like Ehud Barak, or those with a long history of real diplomatic experience such as Bibi Netanyahu, or people who have grappled with the administrative difficulties of running the world’s most complicated and sensitive city such as Ehud Olmert. Is there a serious drop off from Ben Gurion and Rabin to Netanyahu and Barak? Sure. But Avigdor Lieberman represents a crass and disturbing trend that makes the latter group look like veritably Jeffersonian.

Lieberman has no tangible accomplishments to speak of other than being a thuggish party hack. He went from being a student who stirred up tensions between Jews and Arabs at Hebrew University to being a bouncer to being a Likud functionary beholden to Netanyahu. He has become the leader of his party not because of any substantial accomplishments but because of his Russian background. He has been an embarrassment as foreign minister who has complicated Israel’s relations with a number of countries, contributed to the Palestinian Authority’s losing ground to Hamas, and is frequently sidelined by his own government when it comes to carrying out important diplomacy with the United States that cannot be left in his untrustworthy hands. He has gotten to where he is solely because it has become politically beneficial for Netanyahu to cynically rely on him for political cover and because his party is a solid bloc of reliable Knesset votes. I cannot envision a situation in which anyone turns to Lieberman for real advice on issues of diplomacy or security, or where they feel that his sage counsel is necessary. He is the embodiment of everything that is currently wrong with Israeli politics, from his lack of any tact or moderation to his trail of corrupt and unsavory behavior. My fervent wish is that his resigning as foreign minister in the wake of this indictment will cast a new light on him, and that Netanyahu and the Israeli political class realize how much better off Israel is without Lieberman as its face to the world, even if the hiatus is a temporary one. The more that someone like Lieberman – who, let me be clear, I am going after not because of his political views but because of his utter mediocrity – is marginalized rather than elevated to senior cabinet level posts, the better off Israel will be.

The Irrelevant Distraction That Is The Palestinian UN Bid

Since the topic du jour is the UN vote to grant observer-state status to Palestine, I thought I’d weigh in with my two cents. Former Israeli deputy defense minister Ephraim Sneh argues at Foreign Policy that the Palestinian UN bid is actually a good thing for Israel by foreclosing a one-state solution, and I agree with much of what he says in his piece (although I think he is letting his politics get in the way of his objective judgement in blaming Bibi Netanyahu for placing conditions on negotiations rather than acknowledging that it was actually Mahmoud Abbas who imposed a set of preconditions that ended up freezing talks). Whether the Palestinian UN bid is good for Israel or bad for Israel though is in many ways academic, because the reality of the situation is that the UN vote today has almost no relevance to either side. If Israel or the Palestinian Authority thinks that this will mark any type of turning point in how the world conceives of Palestinian statehood, they are both delusional.

To begin with, the most important element for Palestinian statehood is whether or not people think of Palestine as being an independent state-like entity, and the world crossed the Rubicon on that issue long ago. A couple of decades ago, the West Bank and Gaza were almost uniformly referred to as the Palestinian Territories or the Occupied Territories, and only the most ardent partisan supporters of Palestinian statehood referred to Palestine. After the Oslo Accords, which were intended to be the first step on the road to Palestinian autonomy and which created the Palestinian Authority, the discourse began to change a bit and the term Palestine began gaining more currency, but most importantly people began to view the West Bank and Gaza as resembling a state since there was a Palestinian legislature, a president, and other political institutions that one associates with a state. In the subsequent two decades since Oslo, the term Palestine has gone from being a loaded political term to one that most of the world uses in a casually obvious manner, and it is difficult for me to recall the last time I heard the West Bank or Gaza called the Palestinian Territories in any ubiquitous way. What matters for Palestinian statehood is whether people think of the West Bank as constituting a Palestinian state rather than whether an entity called Palestine is a “permanent observer” or “non-member state permanent observer” at the UN. In this case, the dominant casual discourse is more important than international institution legalese.

Second, in 2012 the facts on the ground carry more weight than a UN declaration. Like I said, the Palestinian Authority has a president, a police force, the ability to collect and disburse revenues, ministers with different cabinet portfolios, and a host of other institutions that we associate with states. Partisans aside, most casual observers would look at the West Bank and dub it a separate state irrespective of what the UN thinks. I’ll let you in on another inconvenient fact, which is that Hamas is well on its way to a similar situation in Gaza. Hamas rules Gaza under the auspices of a prime minister, it runs a government with its own headquarters that levies taxes and issues permits, and it ostensibly participates in the Palestinian Legislative Council. As I pointed out last week, Hamas runs Gaza like a separate state and that situation is here to stay, and despite the fact that the UN is unlikely to ever recognize a Hamas-run state in Gaza, plenty of other countries already have. The Qatari emir and Egyptian prime minister have traveled to Gaza on official state visits, and Turkish PM Erdoğan has announced that he might do the same at any time. As much as nobody wants to admit it, Gaza is being treated in some quarters like a de facto state and this trend is only going to grow, and it illustrates again how perception and actions matter a lot more than a UN blessing.

There is an argument to be made that Israel’s primary concern here is that granting Palestine non-member state status will open the door toward prosecution of Israeli officials at the International Criminal Court, but Mark Goldberg has convincingly thrown cold water on that theory by pointing out the ICC prosecutor’s leeway in accepting or declining cases and highlighting the types of cases that have currently been brought before the court. I’m not as sure as he is that prosecuting Israelis would lead to European states withholding funding for the ICC, but I’d throw in the fact that if Palestinians go after Israel at the ICC, Palestinian officials are then opening themselves up to their own charges before the ICC as well, so it is very much a double edged sword. Given all of the above, if I were Israel not only would I not waste any time or effort trying to fight today’s vote, I would actually vote for Palestinian statehood as well. Doing so would go a long way toward rebutting criticism that Israel is not genuinely interested in allowing for a Palestinian state in the West Bank, it would remove from the table an easy issue that people use to bash Israel, and it would create one less headache for the U.S. Israel is fighting a losing uphill battle on the statehood issue, and a meaningless UN vote is not going to change that one way or the other. The only way out is to begin serious negotiations with the PA and get out of the West Bank as soon as is humanly possible, and by dragging things out and losing one public relations battle after another, Israel is not doing itself any good.
