All Politics Is Local, U.S. Visit Edition

Three Israeli and Palestinian politicians visiting the United States were in the news this week for choices they made about with whom or what they wished to associate. Israeli President Ruvi Rivlin came under fire for speaking at the Ha’aretz/New Israel Fund conference despite the participation of the Israeli NGO Breaking the Silence; Palestinian negotiator Saeb Erekat was criticized for speaking at the same conference but demanding the removal of an Israeli flag from the stage as a condition for providing his remarks; and leader of the Joint List MK Ayman Odeh took heat for not meeting with the Conference of Presidents of Major American Jewish Organizations at an office that it shares with the Jewish Agency. Taken together, each of the three incidents is a reminder that there is always a story behind the story, and that it usually involves domestic political considerations.

Let’s start with Erekat, which is the most straightforward. By most accounts, Ha’aretz had no plans to have any flags on stage at its conference, but Rivlin asked for an Israeli flag for his speech, and it remained there until Erekat requested its removal. Those who are angry about the flag’s removal think it indicates that, despite official PLO recognition of Israel, Erekat was signaling that Israel’s very existence is illegitimate in his eyes. Those who find Erekat’s demand justified retort that he is not Israeli, let alone an Israeli official, and doesn’t want to be seen as supporting the country occupying the West Bank. Whatever you think of what Erekat did, it’s fairly easy to understand why he did it. Erekat has been positioning himself for some time to take over for Mahmoud Abbas as the president of the Palestinian Authority, and despite the fact that this seems to objectively be the longest of long shot possibilities, it is one that informs nearly everything that Erekat does. Having pictures splashed across Palestinian media of Erekat standing next to an Israeli flag would not do him any favors – particularly when other speakers did not have the flag next to them – and it probably wouldn’t have mitigated his problems all that much to have a Palestinian flag alongside the Israeli one. While it is perfectly understandable that Israelis were upset by his gesture given the larger issues of recognition and legitimacy involved, it is also difficult to imagine Mikhail Gorbachev during the Cold War going to a conference in Switzerland on U.S.-Soviet issues and consenting to speak with nothing next to him but an American flag, or for that matter Rivlin agreeing to give his speech at this conference next to a Palestinian flag.

Seguing to Rivlin, he has come under intense criticism from the Israeli right for his participation in the conference given the inclusion or attendance of organizations and figures such as Breaking the Silence and BDS champion Roger Waters. It is surprising to some that Rivlin so readily agreed to speak to the conference since in the past he has been more discerning with whom he is willing to associate, famously spurning Jimmy Carter in Israel last spring. To understand what is driving Rivlin, it is important to remember the dictum that where one stands depends on where one sits. While Rivlin has spent much of his adult life as a politician, as the president of Israel his considerations are now different as his career as an overtly political elected official is over. He does not have to cater to a voter base or worry about the Likud primary, and while he maintains a political rivalry with Prime Minister Netanyahu, his task is to present a public face of Israel, largely to foreign audiences. As the head of state rather than the head of government, Rivlin has displayed an acute awareness of the challenges besetting Israel’s image overseas and the frustrations of many Diaspora Jews. Going to the Ha’aretz conference would have been a political kiss of death for Rivlin when he was in the Knesset, but in some ways his most important political constituency now is not Israel’s voters but Israel’s supporters and critics outside of the country’s borders. Making Israel’s case to what was not going to be a fawning audience and presenting a different and more optimistic face to the world than what people get from Netanyahu was probably a relatively easy decision for Rivlin to make as president of Israel, but the outcome would have been different were he a Likud minister.

That brings us to Odeh, who requested to have his meeting with the Conference of Presidents moved to the offices of the Union for Reform Judaism in the same building in a bid to avoid having to interact with the Jewish Agency but was rebuffed. This came off as an extreme move to many American Jews given Odeh’s reputation for moderation and the largely good press he has received while on his U.S. visit, and the Conference of Presidents reacted with a strident statement of disappointment. For a politician touted as a new breed of Israeli Arab leader, this appeared to be a misstep borne out of inexperience, and that might be an accurate description of what took place but it also ignores Odeh’s primary consideration, which is his own political survival. The Jewish Agency is a primary bête noire of Israel’s Arab citizens given its role in land policies that prioritize Jews at Arabs’ expense, so Odeh’s redline makes perfect sense for a politician touring the U.S. whose goal for the trip is to give a voice and draw attention to those citizens. Put simply, Odeh would not be representing his constituents accurately were he to validate an institution in the U.S. that he shuns in Israel.

In addition, much of Odeh’s political power comes from the fact that he was the first MK able to unite Israel’s Arab parties into one united electoral list, magnifying their influence at the polls. This was not, however, an easy task, and it remains to be seen whether Hadash, Balad, Ra’am, and Ta’al will stay united for more than one election given the enormous variance between the parties in ideology, outlook, tactics, and their fractious history. While it might seem that Odeh’s political primacy would be safe in light of his newfound fame and name recognition, he has to contend with challengers within Hadash and the internal politics of the Joint List writ large, and damaging his credibility at home to curry favor with American Jewish leaders is ultimately a losing political move for him.

None of this is to judge the messages that any of these three politicians conveyed through their actions or say whether they were inappropriate or not, but just to keep in mind that politics is a complex game. The politics of foreign visits often compete with the politics of home, and each man’s future ambitions and current position are going to be much greater predictors of how they behave than the expectations and condemnations of their critics. That all politics is local generally explains what goes on in the world, but in Israel this often applies to an even greater degree.

Curb Your Enthusiasm

The sense of renewed hope and optimism in the air surrounding the resumption of peace talks cannot be escaped. As the negotiators from the Israeli and Palestinian sides are preparing to sit across from each other and undertake real and sustained efforts to resolve the thorny issues surrounding the Israeli-Palestinian conflict, all of the major players and influential analysts agree that this time is shaping up to be different and that successful talks are a growing possibility.

Start with the president, who has spent time with both leaders convincing them that the two state solution must be implemented. As he said right before the talks commenced, both the Israeli prime minister and the Palestinian president “have the vision, the knowledge, the experience and the ability and the sheer guts to do what it takes to reach an agreement and then to take it back to their people and see if they can sell it.” At the same time, the White House is not naive about the politics involved and understands that both sides are taking significant risks with domestic constituencies back home, with the president acknowledging that “it’s not easy for either to come. But they have come because they think that the price of not doing it is greater than the risk of going forward.”

Both sides also seem unusually committed to the negotiating process and, in contrast to the past when there was haggling over what could and could not be discussed, this time both sides have stated that all issues are on the table and that the final status issues such as Jerusalem, borders, and refugees will all be negotiated. As the U.S. envoy leading the talks pointed out during an interview on CNN, the Israelis and the Palestinians understand that nothing can be left out this time if there is any hope for a successful deal, which is why the secretary of state spent so much time laying the groundwork for talks. “Prior to that time, each side was very reluctant to get into those kinds of discussions because of the sensitivity of the issues,” he explained. The bad news, he said, “is that there still are significant gaps that separate the two sides.” There is also an understanding that in contrast to previous failed efforts, the talks cannot be open-ended, which is why the U.S. has set a definitive deadline for the two sides to reach an accord – “We’re certainly looking at that as the window in which we’re going to try to produce an agreement with the parties that deals with all of the permanent status issues.”

There is also no question that this is the last chance to get a deal done, since once this window closes, the two state solution will be dead and buried as each side pursues unilateral moves. As Tom Friedman noted in the New York Times, “Trying and failing won’t be any worse than not trying, because without a framework deal for a final peace, the situation will unravel anyway — the Palestinians will unilaterally declare a state by Sept. 13 and Israel will unilaterally annex the West Bank Jewish settlements, and Lord only knows what will happen after that.” It is noteworthy as well that the Israeli PM is moving ahead with talks despite a very shaky coalition that may be on the verge of breaking up over the issue, which indicates that he feels the sense of urgency as well.

As Ecclesiastes presciently noted, there is nothing new under the sun – all of these quotes and facts are from July 2000, right before the start of the Camp David talks between Ehud Barak and Yasser Arafat, but they fit in precisely with the quotes and commentary in the past couple of days about the current round of Israeli-Palestinian peace negotiations. The optimism that both leaders are serious – Roger Cohen is already comparing Bibi Netanyahu’s peacemaking credentials to those of Menachem Begin, who signed the 1978 Camp David treaty with Egypt, before anything has even happened – in large part because the thorny issues are on the agenda and the ubiquitous observations that this is the last and only hope to preserve a two state solution are an exact replay of 2000. Things are reaching such absurd heights that without calling anyone out by name, I read multiple breathless posts yesterday expressing optimism because of remarks and promises made during the introductory press conference, which to my mind is comical. We are supposed to be encouraged because right when both sides have agreed to sit down with each other they make all sorts of hopeful promises, and Kerry in his role as process overseer has stated that there will be no leaks? It’s like a parody of the way Politico covers the horse race of domestic politics, and I think a healthy dose of perspective is in order. A number of people have asked me why I haven’t written anything since last week about the negotiations, and the answer is that there is nothing to write since nothing has happened. I happen to agree that the option of the two state solution will not be around forever, and I am hopeful that these talks will lead to some tangible success, but if you think that anything that anyone says before the two sides have even sat down in earnest makes one lick of difference, then I think you are letting your emotions get the better of your analysis. So, let’s all take a collective deep breath, realize that this round of talks is the last ditch effort before the next round of talks becomes the new last ditch effort, take reasonable stock of actual structural reasons why success or failure are likely, and stop giving the peace process the 24 hour news cycle treatment.

Optimism and Pessimism On The New Round Of Peace Talks

Now that reports are surfacing that negotiations between the Israelis and the Palestinians are scheduled to begin in Washington on Tuesday – although there are also conflicting reports that Saeb Erekat is going to stay home until the Israelis agree to use the 1967 lines as the basis for negotiations over the final border – it seems like a good time to lay out some reasons for optimism and reasons for pessimism about whether these talks are fated to go anywhere. Since I am generally pretty cynical about such things, let’s start with the reasons why I think the talks may fail. One of the biggest obstacles is the domestic politics involved. Brent Sasley has written a thorough piece arguing that the politics right now on the Israeli side are actually favorable for meaningful negotiations and concessions, but I tend to see things differently. Prime Minister Netanyahu has not shown the willingness in the past to actually deal with the hard choices involved in coming to an agreement, and while that does not mean that he is incapable of doing so, nothing in his past indicates that he is an enthusiastic peace process negotiator. If he is being dragged to the negotiating table unwillingly through a combination of pressure and quid pro quo for past U.S. security assistance, it is not going to bode well for the final outcome. Even if he is doing it of his own volition, which is certainly in the realm of possibility, the fact that he seems unwilling to accede to measures such as relinquishing sovereignty over parts of Jerusalem – which is going to have to be in any deal that the Palestinians will accept – is a bad omen. Then there is the problem of Netanyahu’s party. The current iteration of the Likud is the most right wing in its history, and a large bloc, if not an outright majority of the party, does not trust Netanyahu and is adamantly opposed to negotiations. In fact, an increasingly large subset of Likud members, led by Danny Danon, have been openly calling for Israel to annex the West Bank and ditch the two state solution in favor of the rightwing version of a one state solution. It is also the case that the more radical Likud members now control the party’s policy apparatus and serve as deputy ministers in the government; in fact, it seems as if Netanyahu is refuting the latest nonsense from Deputy Defense Minister Danon every other week. Sasley argues that this cast of characters is aware that they cannot win without Netanyahu and will ultimately fall in line, but I am not nearly so certain. Plenty of Likud voters will vote for the party if, say, Bogie Ya’alon is the headliner, and I don’t think that the Likud ministers and back benchers are going to sit idly by if Netanyahu begins to give up territory in the West Bank or order the evacuation of settlements. They have staked their political reputations almost entirely on rejectionism of the two state solution, and just because Netanyahu asks them nicely does not mean that they would not rather have a smaller but purer version of the Likud. See the experience that John Boehner has had with his own unruly caucus of House Republican newcomers as a parallel to how this would play out. Furthermore, Netanyahu is being kept afloat by his temporary merger with Yisrael Beiteinu, which he wants to turn into a permanent one. Without the extra YB votes, Likud immediately loses 10-12 seats in the Knesset. The problem is that Avigdor Lieberman is in many ways the original rightwing one stater, and there is simply no way in which he agrees to keep the two parties together once settlements are given up. Netanyahu knows this, which provides another incentive to make sure that talks break down along their usual pattern. The same problem exists with coalition partner Habayit Hayehudi, which has repeatedly threatened to leave the government over the issue of freezing settlements and whose head, Naftali Bennett, is also an advocate of annexation. Sasley argues that pulling out of the coalition will risk breaking the party apart, leaving Bennett politically homeless, and so he can’t risk it. I think the much bigger risk to Bennett is the party folding or excommunicating him for selling out his core principles if he agrees to remain in a government that agrees to extricate itself from the West Bank. After all, the party’s very name – Jewish Home in English – is meant to refer to the entirely of the Land of Israel from the river to the sea and explicitly lay claim to all of the territory as part of the Jewish state. The idea that the greater risk in this lies in leaving the government seems to gloss over the very reason the party exists, its history, and its makeup. There is also the issue of a referendum, which Netanyahu has now promised to hold to approve any peace agreement that is struck with the Palestinians. While the latest poll in Ha’aretz indicates that 55% of Israelis would approve a peace agreement, that is in a generic sense. Once the details are factored in and various political parties and lobbying groups begin to play on Israeli fears about security, sovereignty over Jerusalem and the Temple Mount, the Jewish character of the state, etc. it will be very easy to siphon off entire groups of voters through scare tactics and populist campaigns. That 55% number is a mirage, akin to the way in which Yair Lapid supports a two state solution but is adamantly opposed to any division of Jerusalem; lots of people support a peace deal in theory, but the devil is in the details. Bennett knows this, which is why Habayit Hayehudi has pushed to extend the Basic Law that requires a referendum to approve giving up land that Israel has annexed – East Jerusalem and the Golan – to include the West Bank as well. The hope on the right is that a referendum will doom any successful negotiations for good. Finally, there is the Palestinian side. There is no need to rehash here all of the various arguments over Mahmoud Abbas and whether he rejected Ehud Olmert’s offer of 99% of the West Bank or whether he simply did not respond because Olmert was a lame duck and out of office before he even had a chance. My own opinion is that the truth lies somewhere in the middle, but I am not as convinced as others on the left that Abbas is a willing a peace negotiator. The insistence on preconditions to negotiating is a tactic designed to doom talks, and the fact that Abbas was not willing to jump on Netanyahu’s partial 10 month building freeze a couple of years ago as the excuse he needed to reenter talks does not bolster the case of those who want to pin all of the blame on the Israeli side. Abbas may indeed want to talk, but I do not think it is fair to portray him as champing at the bit to get started. On the flip side, there are reasons to be optimistic. While, as I noted above, Netanyahu has not shown a propensity in the past to reach an agreement that the Palestinians can reasonably accept, he certainly appears to have arrived at the realization that Israel’s international standing is becoming more precarious by the day. The EU guidelines on settlements last week seem to have been a wakeup call of sorts, and his now repeated public warnings that Israel is facing a real prospect of a binational state indicate that his attitude in 2013 is very different than it was during his tenure as prime minister in the mid-90s or during the beginning of his current stint in 2009. In addition, as Dahlia Scheindlin has pointed out, polls consistently and repeatedly show support for a two state solution, 83 out of 120 seats in the current Knesset are controlled by parties theoretically supporting two states, and the support for two states remains even when you add various line items about specific concessions into the polling questions. In this light, the referendum may turn out to be a very good thing, since it will reinforce the move toward a negotiated solution. It is also encouraging that Netanyahu is seeking political cover to do what needs to be done, since if he negotiates a deal that is then approved by the Israeli electorate, it will be difficult for the right to claim that he has overstepped his authority. Finally, there is the fact that the best way for negotiations to succeed is if the specific details are kept under wraps, and any concessions made by either side are not wielded by opponents of two states as populist cudgels designed to doom the talks. John Kerry has done a good job of this by not publicly outlining the conditions that each side have agreed to in order for talks to resume, but even more encouragingly so has Netanyahu. There is currently a purposeful cloud of ambiguity hovering over the question of whether Israel has frozen settlement construction or not, with Netanyahu denying such a freeze exists and Housing Minister Uri Ariel saying that the de facto and unannounced policy in place is not allowing for any new construction. This, more than anything, is the most hopeful sign of all, since if Netanyahu has actually frozen settlement construction while trying to trick his party and coalition into thinking that he has done no such thing, it is a more serious indication of his desire to really strike a deal than any other datapoint I have seen. Peace Process Theater

Today’s developments in Israeli-Palestinian peace process negotiations demonstrate why the two sides, despite the joint statement that they issued reiterating that they are both committed to peace, are in reality farther apart then ever in coming to a lasting, binding agreement. Let’s begin with the turmoil on the Palestinian side of the ledger. The much-anticipated letter from Abbas to Netanyahu was delivered by Saeb Erekat and Majed Faraj, and while there had been speculation that it would contain a threat to dismantle the Palestinian Authority and return day to day control of the West Bank to Israel, the letter reportedly did not go that far, which should be cause for optimism. This means that a small sliver of agreement and coordination still theoretically exists on which to base negotiations.

The bad news is that Salam Fayyad, who was slated to deliver the letter to Netanyahu, was a no-show. There are a number of reasons why this might be, and none of them bode well for the future. Fayyad might have backed out because he does not think another expression of Palestinian discontent is going to jumpstart negotiations, which would signal a worrying degree of frustration on his part. Fayyad is the great moderate of Palestinian politics, and he has enormous credibility with the U.S. and other international actors. He has led the effort to build up Palestinian institutions and improve the West Bank’s economy and security, and he has been largely successful. He is also the rare – or maybe even more accurately, only – Palestinian politician who says the same things in Arabic to his domestic audience as he does in English to an international audience. He has never been accused of inciting or excusing violence, does not glorify terrorists who kill civilians, called for Hamas to recognize Israel years ago, does not have even a whiff of corruption about him, and by all accounts is honest and determined. If Fayyad believes that things have degenerated to the point that this letter will accomplish nothing, the risk exists that he is at the point of abandoning his project of state-building. Fayyad does not have a natural constituency among Palestinians as he is not a career politician or a high ranking PLO member, and if he resigns as prime minister, international aid to the PA will dry up overnight and the situation in the West Bank will quickly deteriorate.

Fayyad might also not have agreed to deliver the letter because Abbas was trying to discredit him by asking him to do it. Today is Palestinian Prisoners Day, in which Palestinians express their solidarity with those in Israeli jails, and the optic of meeting with Israeli officials today is not a popular one. Abbas and Fayyad do not have a good relationship, and it was not improved with the news that the unity deal that Abbas agreed to with Hamas stipulated sacking Fayyad. Abbas might have been trying to embarrass Fayyad even further by demanding that the letter be delivered today, and Fayyad understandably did not want to do it himself. The PA’s footing is tenuous enough already, and it certainly will not be improved by more fighting between its two top figures. If the PA implodes, the party that stands to benefit the most is Hamas, and that will certainly not do any wonders for Israeli security or the prospects of a deal.

Finally, it’s possible that Fayyad did not deliver the letter himself because he does not think that negotiations with Israel are still a viable path to a Palestinian state. Fayyad is on record as being against a unilateral declaration of statehood and did not agree with last fall’s strategy of pressing the UN to recognize a Palestinian state, and if he has one way or another become so disenchanted that he now believes in institution-building for its own sake without it leading to negotiations with Israel, then Israel will have lost in a big way. In many ways, Fayyad is the perfect Palestinian counterpart for Netanyahu, as they have both expressed the opinion that improving the West Bank’s economy and security is a vital precursor to successful political negotiations. If Fayyad does not want to be a part of the PA’s current negotiating process because he thinks it is a waste of time, it would signal the death knell of true moderate Palestinian partnership.

In the meantime, while Israel and the PA held a meeting and issued a joint statement that nobody expects to lead to any real progress, 1200 Palestinians in Israeli prisons began an indefinite hunger strike to protest the practice of administrative detentions and what they allege to be abusive and humiliating behavior on Israel’s part. This more than anything highlights the absurdity of today’s peace process theater. Of these two separate and distinct events, the one that is guaranteed to hold Palestinian attention and support is prisoners going on a hunger strike in opposition to Israel rather than Palestinian negotiators exchanging letters with the Israeli government. Even if Abbas were to drop his preconditions and come to the negotiating table, and the two sides were able to make some progress, is there really going to be much appetite for talks among Palestinians at this point? With hunger striker Khader Adnan being freed today, there is a stark example of what appears to be a successful strategy for countering Israel against the backdrop of endless negotiations that have not produced much in the way of tangible gains. This doesn’t mean that it will lead to Palestinian violence, but it also does not mean that negotiations are still viewed as the only alternative to armed resistance. Of all the days in which the peace process has seemed moribund, today might have reached a new low with its hollow message of two sides working together.

The Pitfalls of Preconditions

Barak Ravid reports in Haaretz that long-time negotiators Saeb Erekat and Yitzchak Molcho recently met in secret in an effort to revive dormant Israeli-Palestinian peace talks, and that the PA has outlined a number of demands that it plans on presenting to Netanyahu as preconditions to negotiations. Unsurprisingly, Abbas’s preconditions are that negotiations begin with a baseline of the 1967 borders and that Israel freeze all settlement activity.

While the Palestinians are in a difficult spot and want to gain some leverage going into peace talks, the preconditions gambit is a continuation of the same negotiating mistake. A little reminder of recent history is helpful in understanding why this is. When AIPAC convened its annual conference in March 2010, the attendees gathered during a particularly rocky period for Israel diplomatically. Earlier that month, Vice President Biden had landed in Tel Aviv to be infamously greeted with an announcement of 1600 new housing units in East Jerusalem which led to a mini-crisis with the United States and an hour-long dressing down from Secretary of State Clinton.  Israel’s deputy foreign minister Danny Ayalon was fresh off causing a diplomatic crisis with Turkey following his attempt to humiliate the Turkish ambassador with cameras rolling in response to Turkish television dramas portraying Israeli soldiers as kidnappers and intentional murderers of innocent civilians. Britain was also threatening to cut intelligence ties and cease intelligence sharing following revelations that Israel had used British passports while assassinating a Hamas military leader in Dubai.

Most importantly, serious pressure was building up for Israel to make real concessions in service of creating an independent Palestinian state. President Obama had called for Israel and the Palestinian Authority to resume negotiations and had pressed Israel for a freeze on all settlement activity. The PA seemed for the first time in nearly two decades to be making progress in building state institutions in the West Bank, and the U.S.-trained PA police force was winning accolades for its progress and professionalism.  There was also a growing sense among military officials that a lack of progress on the Israeli-Palestinian front was becoming a problem for the U.S., embodied by General David Petraeus’s Senate testimony that anti-American sentiment in the Middle East was partly due to the absence of a Palestinian state.  The momentum for an independent Palestine was building, and following the Biden episode and the fury among top U.S. officials at what they saw as an unacceptable humiliation of the vice president, the Palestinians were in an ideal situation to negotiate a favorable resolution to the conflict.

Such negotiations never took place, however, because the Palestinian Authority committed the crucial mistake of setting preconditions before coming to the negotiating table. As every first year law student required to read the seminal negotiation treatise Getting To Yes can tell you, setting preconditions to negotiating is a tactic that almost always fails. The book’s very first lesson is not to bargain over positions as it is inefficient, damages the relationship between parties, and leads to bad agreements. Tactics such as setting preconditions and refusing to negotiate until they are met are fated to backfire if the objective is to reach an agreement, as the other side is likely to dig in and paint the refusal to negotiate as evidence of bad faith. Over time, the party setting the preconditions will become hostage to the perception that it has no interest in reaching a deal, and will then be forced to maintain its principled position even when events on the ground put it at a disadvantage or give up credibility and leverage by dropping its demand entirely. In short, setting preconditions before agreeing to negotiate an agreement is rarely going to be a winning strategy.

In early 2010, Abbas insisted that no negotiations could take place absent a complete freeze on all building activity in the West Bank and East Jerusalem, which was a condition that Israel was in no way prepared to meet given the extension of the freeze request to East Jerusalem.  Netanyahu did, however, agree to a 10 month West Bank settlement freeze, allowing him to take the high road by announcing that he was making concessions and was ready to negotiate at any time while portraying the Palestinians as unwilling peace partners. By September 2010, following months of demands that Israel freeze all East Jerusalem construction, the Palestinians finally agreed to negotiate, but by that point it was too late, as Israel’s settlement freeze expired. Events on the ground had also shifted by that point and Obama announced his unwillingness to ask the Israelis for yet another halt to all West Bank building activity, and the Palestinians were in no position to make a credible case having squandered months of potential negotiations. Fast forward two years later to the most recent AIPAC conference, and the Palestinians and peace negotiations barely registered with attention turned exclusively to Iran.

Despite all this, Abbas is about to pull a Groundhog Day and make the exact same mistake, although this time his starting point is far less favorable and thus his tactic is even more unlikely to work. The question is whether the PA actually wants to have serious negotiations at this point in time or is just looking to win a p.r. battle with Israel. If it’s the latter, then setting preconditions makes sense since it highlights Israeli settlement activity, which is already being cast in an unfavorable light following the High Court’s Migron decision and the current standoff between the IDF and the prime minister’s office over the Beit Hamachpela group in Hebron. If the objective is to actually negotiate though, Abbas and Erekat need to wake up to the fact that setting preconditions is a terrible negotiating strategy that is fated to fail from the start.
