The Problem With Religious Monopolies

Since Israel’s founding, the Orthodox movement has had a monopoly on the official practice of Judaism in the state. Gershom Gorenberg’s superb book The Unmaking of Israel goes into the way this came about and the problems with it in great detail, but the short summary is that the Orthodox chief rabbinate controls marriage, divorce, and conversion, giving it absolute power over who is considered a Jew and of the largest personal milestones in the Jewish life cycle. The monopoly that Orthodox Judaism has is so absolute that Israel does not even recognize Conservative and Reform rabbis as being rabbis, and instead categorizes them as community leaders. This would not matter in practice except for the fact that the state pays the salaries of Orthodox rabbis to provide religious services to municipalities and communities, and does not do so for non-Orthodox leaders as they are not recognized as having rabbinical authority.

In May, the Israeli government announced that it was going to correct this imbalance and begin recognizing Conservative and Reform rabbis and pay their salaries as well. The financing is slated to come from the Culture and Sports Ministry rather than the Religious Services Ministry, and the Conservative and Reform leaders are to be called “rabbis of non-Orthodox communities” so as to effectively put an asterisk by their names, but this is undoubtedly an important progressive step nonetheless, especially given the fact that the majority of Israelis are not Orthodox and this in no way infringes upon Orthodox Judaism’s own practices and strictures that it sets up for itself.

Sadly predictably, however, there has been a huge backlash from Orthodox rabbis against the government’s plan. This week, Sephardic Chief Rabbi Shlomo Amar sent a letter to hundreds of Orthodox rabbis in which he called for them to fight the government’s plan and reimpose the absolute religious monopoly that he and his compatriots have enjoyed. He also made his pernicious views on non-Orthodox rabbis crystal clear, expressing his “sorrow and terrible pain” over the recognition of “uprooters and destroyers of Judaism who have already wrought horrible destruction upon the People of Israel in the Diaspora.” Rabbi Amar and the Ashkenazi Chief Rabbi Yona Metzger have called a strategy meeting for Tuesday and declared rabbinical attendance to be mandatory, and no doubt both of them will have some more unpleasant words for those with whom they disagree. Israel now faces the specter of one arm of the state – the Chief Rabbinate, which is an official state office – actively working to subvert the government and the High Court, and having its chief rabbis openly call for the attorney-general to consult with them before issuing legal directives. This is, of course, completely outrageous, particularly since the decision to recognize Conservative and Reform rabbis does not affect the Orthodox in any meaningful way other than diluting their political power and hold over the 70% of Israeli Jews who are not Orthodox, and the Chief Rabbinate is marshaling all of its resources in an effort to maintain rank state discrimination in an area in which the state should not be choosing sides. All of this is a sad consequence of the religious monopoly that Orthodoxy was granted at the state’s founding, since over decades this monopoly over religious ceremony has been internalized in a way that has led many Orthodox rabbis in Israel to believe that no other branch of Judaism is even legitimate.

One of my closest friends and college roommate, Ephraim Pelcovits, is the rabbi of the East 55th Street Conservative Synagogue in New York. Ephraim is an astoundingly deep thinker on all issues under the sun but particularly on the role of religion in Israel and Jewish communal issues more broadly. Over too many hours-long conversations throughout the past 15 years to even count, he has been a major influence on my thinking on Israel, Israeli politics, and Judaism. Since this appears to be guest posting week on O&Z, and since he is uniquely qualified to speak on this topic having grown up in the Orthodox community in the U.S. and spent a year of his rabbinical training in Israel, I present to you Ephraim’s thoughts on Rabbi Amar:

 

This Saturday, Jews all over the world will read the Bible portion dealing with the rebellion against Moses’ leadership, led by a party so uninterested in dialogue or reconciliation that it was designated as “evil” by God for its constancy in conflict, and was later held up by the Jewish tradition as the paradigm of senseless infighting.

Earlier this week – just as world Jewry was about to get its annual reminder about the dangers of senseless conflict – Rabbi Shlomo Amar, the Sephardic Chief Rabbi of Israel, decided to designate me – and all my colleagues in the liberal rabbinate– with that same moniker in a letter he distributed on his official government stationary. We – Conservative, Reform and Reconstructionist Rabbis – were disparaged as “…enemies of God, wicked people who are like the turbulent sea that cannot be quieted, their entire aim being to do harm to the sanctity and purity of the Torah in our Holy Land…”

The cause of this vituperative rant? A decision by the Attorney General of Israel’s Office to begin paying the salaries of non-Orthodox rabbis who serve in Regional Councils or in Agricultural Settlements, just as it has always done for their Orthodox counterparts.

Obviously it is inappropriate for a State employee – like Rabbi Amar – to use the trappings of his office to lobby for a personal initiative – in this case the overturning of a new State Law which begins to allow for religious pluralism in Israel.  Yet what really terrified me as a religious leader was reading the fierce and dehumanizing tone of his letter, including the highly incendiary language Amar uses to describe the non-Orthodox movements and their leadership.

For the rabbis of the classical period, God’s designation of the rebels against Moses as evil opens a broader discussion of other villains marked with the same moniker, a list which includes those who seeks to do physical harm to their peers as well as those who borrow money and refuse to repay their loans.

It seems to me that Rabbi Amar misses the entire point of the classical rabbinic teaching on this week’s Torah portion. What I believe the ancient rabbis were teaching by connecting the ills of physical violence and shirking loans with the theme of provoking conflict is that all three will lead to the crumbling of society.

Let me explain that connection.  In a culture like that of Traditional Judaism, which forbids interest paying loans between community members, the presence of even one shirking borrower threatens the ability of all those in need from receiving money from their more fortunate brethren. The resulting freezing of credit parallels the power of the violent and of the provocateur to rip apart a tight knit community. All of these actions – which tear tenuous human connections apart – are designated as evil.

This Saturday, in my synagogue, we’ll take a stand for community and join together with our brethren the world over to hear the traditional narrative read from them Bible. When we finish hearing the story of a rabble rouser from Biblical history, I will tell my congregants about a contemporary thug – Rabbi Shlomo Amar – who is using his government office and it’s powers to tear our people apart, and to label us – members of a Conservative Synagogue – as “uprooters of the faith.” I will then encourage those in attendance to take a stand against incendiary speech, and to make connections and open dialogue with people – Jews and non-Jews – who live religious lives that look different than ours. Israeli society and democracy is too precious – and too precariously held together – for Rabbi Amar’s fear driven brand of Judaism to hold a monopoly on Israeli religious expression!

Syria: Bringing Former Friends Back Together

Michael Herzog and Soner Cagaptay have an op-ed in today’s New York Times on Israel-Turkey relations in which they argue that the situation in Syria can provide the impetus for the two countries to reconcile. I was reluctant to comment on it since I have an op-ed of my own coming out soon on steps that need to be taken for Israel and Turkey to make up, but I think their piece has some flaws that I can’t help but point out. I am no stranger to the Syria argument, having pointed out before that it would be to both states’ benefit to cooperate on Syria. Herzog and Cagaptay take this idea a few steps too far, however, by essentially arguing that the mess in Syria can be the primary force that will move Jerusalem and Ankara back together.

The first problem with this is that while Israeli and Turkish cooperation would be nice, Syria presents a very different set of problems for each. Turkey is facing a serious refugee crisis with Syrians fleeing across the Turkish border, the prospect of revitalized PKK terrorism if Assad provides the PKK with a safe haven inside Syria, and reputational and credibility problems following early Turkish threats to establish buffer zones inside of Syria that are clearly nowhere close to materializing. In contrast, Israel is facing the possibility of Assad and the Syrian army stirring up trouble with Israel in an effort to distract from the massacres being carried out by Assad’s forces, Hizballah shooting volleys of missiles into northern Israel in response to alleged “Israeli meddling” in the conflict, and the inclusion of Islamist elements dangerously hostile to Israel in the Syrian opposition. So yes, in a wider sense, both Israel and Turkey are facing problems because of the brewing Syrian civil war, but that does not mean that cooperation between the two is such a no-brainer that it will get them to reconcile. For instance, would Israel help install the Syrian National Council in Damascus in order to stem the flow of refugees into Turkey if it means that it now faces Islamist governments on its southern and northern borders? Does Israel have anywhere near the level of interest in driving the PKK out of Syria as Turkey does? Yes, both countries want a resolution of some sort, but it is entirely unclear that they would agree on what that should be.

Second, Herzog and Cagaptay argue that any Israeli involvement in Syria has to be secret:

Any Israeli contribution would, of course, have to be invisible in order not to create a sense that Israel was behind the Syrian uprising. This makes Turkish-Israeli cooperation against Mr. Assad even more valuable, for it would allow Israel to provide untraceable assets to support Turkey’s efforts to undermine the Assad government.

Well, doesn’t that contradict the premise of the entire argument? Israel and Turkey are very publicly at odds, and any reconciliation is going to have to be a public one as a result. Much of the benefit of reconciling, and this is particularly true for Israel, is a public relations one, so some sort of secret rapprochement that nobody knows about outside of the respective countries’ militaries and intelligence services does not do much good. The notion that Israel would agree to help out Turkey but do so in an untraceable way is not a point that bolsters the argument that cooperation on Syria is going to lead to a reconciliation. It might be an important confidence building measure, but if you are claiming that the Syria mess is going to push Israel and Turkey to repair their relationship, you had better come up with something more than covert intelligence assistance.

Then there are a bunch of smaller problems in the piece. The authors assert that “A Turkish-Israeli dialogue on Syria could bolster Israel’s interest in regime change and enlist Israel to generate American support,” but I hardly think that Israel voicing its approval of a Turkish plan to get the U.S. involved is going to sway the administration’s impulse to stay out of things. They also argue that Shaul Mofaz’s inclusion in the cabinet dampens the influence of Avigdor Lieberman and his strident criticisms of Turkey, but Lieberman is hardly the only politician to have a hard line on a flotilla apology and there is no evidence that Mofaz is itching to pursue normalized ties. There is no discussion in the piece of the larger structural incentives that might push Israel and Turkey to reconcile, since the Syria issue has not been enough up until this point. In sum, I don’t think that Herzog and Cagaptay are wrong to identify Syria as a problem for both Israel and Turkey, but the overall argument flies right over so many important details that to me their op-ed fails to convince.

Guest Post: Which Side Is It That Is Actually Politicizing Israel?

Following my post last week about the GOP turning Israel into a partisan issue, my friend Gabe Scheinmann emailed me to register his disagreement with what I had written. Gabe and I met when we were at Harvard and we both ended up as PhD students in the Government Department at Georgetown, and he is currently a Visiting Fellow at the Jewish Institute for National Security Affairs. Gabe is a rising star in conservative foreign policy circles, and I always take his unfailingly intelligent and informed views on security policy very seriously. Gabe has a different take on who is responsible for politicizing Israel as an issue in U.S. elections, and I asked if he would be willing to write a guest post laying out his rebuttal to my argument and he graciously agreed. Here is Gabe on the differences between the Republicans and Democrats on Israel and which side is more responsible for playing politics.

Making “Israel” into a partisan issue football is bad for Israel and bad for America. A true alliance does not bloom and wither based on the party in power, but instead represents long-term interests. By politicizing such an alliance, both political parties, and both countries for that matter, are jeopardizing the crucial trust and commitments needed for a fruitful relationship. Moreover, the current parties’ dispositions on Israel have not always been the same. Prior to the Nixon Administration, it was the Democratic Party that was a great friend of Israel, from immediate political recognition from Truman to the beginning of a military relationship under JFK. In contrast, the greatest crisis in U.S.-Israeli relations to this day occurred during a Republican Administration, when an irate Eisenhower browbeat Israel over its invasion of the Sinai and Suez Canal in 1956. Three decades from now, the parties’ identities may yet again change and it would be a disservice to the U.S, Israel, and the alliance if the parties were to develop diametrically opposed views on the subject.

That said, I think the real culprit is that for the first time in a long time, real differences have emerged between the two parties regarding their policies towards Israel. The Democratic Party’s lurch leftwards on foreign policy—partly a result of Vietnam, partly due to demographics—has also shaken its once solid support for Israel. The Democratic Congressional leadership remains very pro-Israel, way more so than the current president. But if you look at poll after poll of Democrats, especially liberal Democrats, what you find on Israel is very troubling. Whether it’s the J Street crowd (whose leadership is way more right-wing than its supporters, and that’s saying something), or the African-American community, or the environmentalist community, or the gay community, you’ll find some terrible sentiments on Israel. The ritual condemnation of Israel by supposed “human rights” organizations, all left-leaning, are manifestations of this. And while the Democratic leadership is indeed pro-Israel, the ranks of the Democratic party are not. The “Gaza-54” letter, asking Obama to pressure Israel to ease the Gaza blockade in 2010, was signed exclusively by 54 Democratic Congressmen, Rep Jim Moran (D-VA) blamed the Iraq War on AIPAC—earning the rebuke of Rep. Steny Hoyer—and, most recently, the New York Democratic Party establishment has come out against Charles Barron, the former Black Panther running for Congress, for his anti-Israel and anti-Semitic positions, even though he has been endorsed by the retiring Congressman whose seat he’s running for.

Moreover, President Obama himself has politicized Israel policy to a degree unseen in decades. The Obama Campaign put out a glossy, epic-music-leitmotif video on its “exemplary” record on Israel, the White House (note: not the campaign) has a webpage exclusively devoted to the president’s Israel record, longer than the entirety of its foreign policy page, and the president himself declared that he “has done more in terms of security for the state of Israel than any previous administration” and knows more about Judaism than any other American president. The list goes on. Obama has spoken at AIPAC two years in row, a first for a president. The recent spate of national security leaks—authorized or not—have served to make the president look tougher to his electorate, while compromising real national security, such as the disclosure of the joint U.S.-Israeli cyberwarfare campaign against Iran’s nuclear program, which has a direct quote from VP Biden blaming Israel.  In addition, Biden has recently reemphasized the president’s campaign speech of last October, also expounding that “I believe that no president since Harry Truman has done more for Israel’s physical security than Barack Obama”, even managing a small dig at the Bush Administration for supposedly not putting enough pressure on Iran.

Moreover, the President’s Israel policy seems dictated not by U.S. national security, but by his own reelection campaign, as his policies on the peace process and Iran have morphed as the November approaches.

Take the Peres ceremony. To be clear, if the GOP leadership was indeed invited, they should have gone. (However, Kampeas’ blog postings on the subject are far from definitive as to who was actually invited and who was out of town, so I’m not sure there’s solid evidence that the GOP absence was out of spite for Obama’s Israel record.) Notice the glowing and unprecedented reception the White House gave Peres compared to its shabby treatment of Netanyahu, Israel’s actual leader. Notice Obama quoting extensively from Peres’ 1993 Nobel peace prize speech, or the very act of giving Peres the medal, or more importantly, singling him out for a separate ceremony than the rest of the recipients the previous week. For example, when Obama gave Bush 41 the same medal two years ago, not only was it not a black tie event, nor at night, nor a reception, but he was one of fifteen recipients! This was an entire political operation by the president, from the decision to award the medal, to the manner in which it was presented, to the themes hit upon. (Notice how Peres brought up Iran, while Obama didn’t.) Obama’s message to Bibi was “See how I’ll treat you if you believe in what I believe”. It was a no-so-subtle dig.

To conclude, I believe that the core of the Democratic party has moved far leftward on foreign policy and, as a result, it is losing its reliable pro-Israel bent. This has begun to trickle up the ranks of its leadership, but for the moment its Congressional leadership is still solidly pro-Israel, more so than the president himself. So, what should the GOP or, for that matter, pro-Israel Democrats do? In order to keep Israel bipartisan, should they compromise? How should the Republican Party respond when the White House attempts to impose a settlement freeze on Israel, or equates the Holocaust with Palestinian suffering, or denies the existence of Bush era assurances to Israel, or attempts to refund UNESCO in contravention of U.S. law, or opposes the counting of Palestinian “refugees”?

In the past 5 years, substantive differences have emerged between the two parties on Israel, largely a result of a shift in the Democratic party. The emergence of groups like the Emergency Committee for Israel is a consequence, not a cause, of this shift and is merely trying to highlight these differences while ultimately letting voters decide. If the differences between the two parties, or Obama and Romney, were invented, then that would be a different story. However, they are not and therefore ought to be debated.

Exposing the Lie of Hamas Moderation

Hamas seems to be begging Israel to launch Operation Cast Lead, The Sequel. 45 rockets were fired by Hamas into Israel on Tuesday following the cross-border attack from Egyptian territory on Monday, confining much of southern Israel to bomb shelters. There is never an excuse for rockets directed toward civilians, and Hamas is barely even pretending to have a justification this time around. Hamas claims that the rocket barrage is a response to Israeli airstrikes, but the real reason Hamas is now returning to its strategy of indiscriminately targeting Israeli civilians is that it is beginning to feel squeezed by other groups that are questioning Hamas’s commitment to armed resistance. As pointed out in the New York Times, Islamic Jihad’s more militant approach has garnered it growing popularity and Hamas does not want to be eclipsed by its smaller competitors. More saliently though, the attack on Monday coming from the Sinai and for which a group claiming to be affiliated with al-Qaida has claimed responsibility put even more pressure on Hamas, since it cannot afford to be seen sitting on the sidelines while an outside non-Palestinian group carries the banner of resistance against Israel. Hamas is madly trying to reestablish its credentials of taking the fight to Israel, and it does so by firing rockets from Gaza because it has no other long term strategy and no interest in a productive solution. It is being tarred as too compliant and willing to live with the status quo, and so Israeli civilians have to bear the brunt of it reflexing its muscles. Let’s also not pretend that any of this is a “legitimate response to Israeli aggression” since it’s pretty clear who made the first move here, not to mention that purposely targeting civilian communities with rockets is never a legitimate response to anything.

Hamas is gambling that with Israeli tanks moving toward the Egyptian border and Iran presumably occupying the Israeli defense ministry’s attention, the IDF will have neither the time or the inclination to bother with a large scale response to rocket fire that has thankfully not killed any Israelis yet. This is a bad miscalculation on Hamas’s part. Israel’s first priority is protecting its citizens from attack, and should this rocket fire continue, I fully expect to see an IDF incursion into Gaza. Israel is not going to be frightened off by a Morsi victory in Egypt, and is also unlikely to sit back and absorb rocket fire as a favor to the Egyptian military, which does not want to be pressured by public opinion into fighting Hamas’s battles. This is not destined to end well for Hamas should it provoke a real Israeli response, and yet Hamas is bafflingly more concerned with not being outshined by smaller resistance groups.

In this vein, the most important takeaway from this episode is that it is time to lay to rest forever the idea that Hamas is moderating or will moderate. When Israel pulled out of Gaza and Hamas took control of the strip from the Palestinian Authority, I thought there was a small but legitimate chance that Hamas would begin to transition away from terrorizing Israeli civilians and start focusing on governance. Any hopes I had on this front have been thoroughly dashed. Despite the recent relative quiet, it is clear that Hamas is not changing. It remains a revanchist group dedicated not to building a state but to seeking the elimination of Israel entirely, and it continues to be a hostage to small bore thinking without seeing the larger trends at work in the region. Islamist groups throughout the Middle East, from Ennahda in Tunisia to the Muslim Brotherhood in Egypt, are devoting their attention to governing, and while they are not necessarily forces for moderation or social progress, they recognize that the key to long term survival and relevance is basic party politics and the nitty gritty of learning how to run a state. Hamas evinces zero interest in following this path, which should permanently kill the notion that it is a legitimate Islamist political party that also happens to have a military wing. It is everlastingly obsessed with the idea of resistance above state building, purity above compromise. Is there anyone left still so naive as to think that a complete and total Israeli pullout from the West Bank would put an end to Hamas rockets, attacks on civilians, and efforts to abduct Israeli soldiers? Rather than prepare its constituents to live with the inevitability of Israel and attempt to improve their lot, Hamas is more concerned with looking tough and whether other groups are damaging its street cred. What a terrible and pathetic representative for the people of Gaza.

Look at the revolutionary trends rocking the rest of the Arab world, and then compare that to the stale stasis that grips Hamas as it remains impervious to change or adaptation and refuses to embrace any new role other than resistance in the form of barbarism. It is as it always was: an opaque organization with a super secretive process for selecting its leaders and making decisions, with the only difference that it now shoots rockets at Israeli civilians rather than blowing them up on buses or in cafes. I desperately think that Israel needs to deal with the Palestinian Authority to end the occupation of the West Bank and establish a Palestinian state, but Hamas is an altogether different breed and its actions yesterday were the latest abundantly clear demonstration of this. The attack from the Sinai and the rockets from Gaza are an important reminder that Israel lives in a nasty neighborhood and that there are some things which it will never be able to inoculate itself against no matter how it resolves the Palestinian issue. Nobody argues that Israel is threatening or occupying any part of Egypt and yet it still faces attacks coming from the Sinai, which pose a terrible dilemma for Jerusalem since it does not want to enter into any hostilities with the Egyptians but cannot afford to just let these provocations continue. This is where the double standard that governs all things Israeli kicks in, since every country in the world has the absolute right to respond to cross-border attacks (and this applies both to Egypt and Gaza) but by doing so Israel walks into an inevitable public relations trap. If Israel goes back into Gaza, every Palestinian civilian life that is lost will be an unqualified tragedy, but it will be entirely on Hamas’s head.

The Gülen Invitation

Recep Tayyip Erdoğan made a big splash last week with his very public (albeit veiled) call for Fethullah Gülen to leave his self imposed exile in Pennsylvania and return to Turkey, and Gülen made just as big a splash with his tearful video announcing that he is staying right where he is. The entire incident was very strange, as it comes on the heels of an increasingly confrontational clash between Erdoğan and the AKP on one side and the Gülenists on the other. The Gülen movement was an early and important supporter of the AKP, but tension has been building between the two camps and is finally out in the open in the fight over Turkey’s special authority criminal courts, which have been the vehicle used to prosecute military officers and journalists and which are presumed to be controlled by Gülenists. Erdoğan has been annoyed since a Gülenist prosecutor attempted to question Hakan Fidan, his national intelligence chief, and a couple of weeks ago the prime minister opined that the special authority courts have gone too far and need to be curbed, accusing them of acting as if they are above the state. This criticism was unmistakably aimed at the Gülenists, and it prompted a furious backlash from the movement. Today’s Zaman, which is the English language version of the Gülen movement’s flagship newspaper, ran two articles recently that were extraordinary in their criticism of Erdoğan and the AKP, blasting the party as authoritarian and accusing it of endangering Turkish democracy. From a paper that has spent the five years since its founding boosting Erdoğan and the AKP relentlessly, this is a remarkable turn of events.

Against this backdrop came Erdoğan’s invitation for Gülen himself to come back to Turkey. The timing seems strange, and there are a lot of theories flying around as to why he did it. It might have been to demonstrate that, rifts with the Gülen movement aside, Erdoğan is still on good terms with Gülen himself; or to highlight Erdoğan’s self-confidence; or to begin repairing the divide between the AKP and the Gülenists. I, however, have a different theory. Ever since Fidan was targeted, Erdoğan has been pushing back strongly against what he sees as a movement that has grown too big for its britches. In a major show of power, the government last week abruptly removed the chief prosecutors from the Ergenekon, Sledgehammer, and soccer match-fixing cases – all of which have been driven by Gülenists – and reassigned them to different posts. While the three were all technically promoted, the message sent was crystal clear: the AKP, and not the Gülen movement, controls Turkey, and this includes the police and the judiciary, which are Gülen strongholds. Erdoğan also threatened to eliminate the special authority courts entirely, and has recently been standing up for the military, which is the béte noire of the Gülen movement.

I think that Erdoğan’s invitation for Gülen to return was an effort to put Gülen himself squarely in the prime minister’s crosshairs. It is difficult to target a phantom presence, and Erdoğan’s confidence and position as the colossus of Turkish politics leaves him unable to abide the power, whether real or perceived, of a legendary imam who is basically untouchable at this point. If Gülen returns to Turkey, much of his mystique evaporates, and it lets Erdoğan tackle him on more equal footing. Gülen will be out in the open and viewed as a normal (while still revered) public figure, subject to political caricature and debate. Erdoğan knows that he cannot really tangle with Gülen while he is in seclusion in the Pennsylvania woods since it risks debasing the prime minister’s image and won’t get him anywhere, but a Gülen who is back in Turkey is a different matter. This is why Erdoğan wants him back in Turkey, and why Gülen will never consent to returning. Erdoğan’s invitation was a poison pill, designed to mortally wound Gülen if he accepted it. It was a typically clever political move by Erdoğan, and combined with the other shots he has taken recently at the Gülen movement, it puts them on notice that he is not to be trifled with. It is understandable that the Gülenists have been spinning this as a sign of the deep respect that Erdoğan has for Gülen, and the prime minister is smart not to contest that interpretation of events, but viewed in context with chain of events from the past few months, I think that Erdoğan wants to take the leap from criticizing the Gülenists to challenging their spiritual leader as well. If Gülen ever returns to Turkey, it makes that possibility ever so much easier.

What Democracy Is, and Is Not

I know I should be writing about Israel or Turkey (and Turkey has plenty of interesting stuff going that I want to get to, particularly surrounding the elusive Fethullah Gülen and Prime Minister Erdoğan’s very public invitation for him to return), but I can’t stop watching what is going on in Egypt. Just as voting got underway yesterday in the second round of Egypt’s presidential election – voting which was hollowed out by the dismissal of parliament last week – the SCAF issued a constitutional declaration expanding the military’s powers over the president and the constitution writing process. Among other things, the SCAF gave itself veto power over any new constitutional elements proposed by the Constituent Assembly, which it has also given itself the power to appoint, and required the president to get its approval before going to war. In a nutshell, the SCAF essentially institutionalized its position as sitting above the rest of the political system with oversight of all relevant executive, legislative, and judicial bodies, and is unquestionably the highest power in the land irrespective of who the next or future presidents are. Some are looking at this as a preemptive strike against a Morsi presidency, and that may well have been the point, but these moves make democracy in Egypt an absolute and complete impossibility no matter how many free and fair elections take place down the road.

It’s worth thinking a little about why this is. This same issue comes up with regard to Iran, where people sometimes claim that Iran is a democracy or somehow more democratic than its Arab neighbors because it has an elected president and legislature with campaigns that feature genuine choices in the voting booth. This claim is utterly false. Despite its elections, Iran is not a democracy because even a minimalist electoral democracy is about much more than just elections, and Egypt today officially entered a pattern in which it too cannot attain democratic status unless the new constitutional provisions are discarded. Neither Iran nor Egypt have what is called vertical accountability, meaning that there is an unelected group that has a reserved domain of power and that stands above elected officials without being accountable to the electorate. In Iran that group is the Guardian Council and the Supreme Leader, and in Egypt it is now the SCAF. The elected president of Egypt is subject to a military veto, and the military is accountable to nobody. Egypt can hold elections every four years that are unassailably free and fair with regular transfers of power between parties, and none of it will matter because Egypt will still not be democratic.

In a way, what has taken place in Egypt is a lot more problematic than the type of military coup seen in Turkey or Latin American countries during the latter half of the last century. When the military intervenes in politics to depose an elected civilian government, it often does whatever it feels needs to be done and then returns to the barracks. As was the case in Turkey, this did not mean that another coup would not happen in ten years, but at least in the interim civilian politics was given a chance, albeit with the omnipresent specter of the military hovering over the proceedings. In Egypt, however, the SCAF is not simply intervening in civilian politics; it is establishing a permanent military veto and permanent martial law that will exist in conjunction with civilian politics. Even if the military does not ever actively remove the president, the president cannot go to war without the SCAF’s approval or do anything to curb the military’s power to indiscriminately arrest civilians or remove SCAF oversight of the legislative process. This is more insidious than a temporary military coup, because it permanently cements the subordination of elected officials to unelected generals. As much as the military was preeminent under Nasser, Sadat, and Mubarak, this is a step even farther, since now the military will be actively involved in governing. Nobody should fool themselves about what it means should Morsi actually be declared the winner of yesterday’s election; just because he wins and Shafiq – widely presumed to be the SCAF’s favored candidate – loses does not make for a triumph of democracy, or even a glimmer of hope. There is no democracy in Egypt, and that won’t be undone through the process of elections.

One final thought about Egypt and democratic transitions. For the last year and a half, it has been fashionable to talk about Egypt’s transition or Egypt’s emerging democracy. Neither of these terms was ever accurate. A democratic transition is a frustratingly nebulous concept, and there is no good way of measuring when one has actually occurred and a state has crossed some magic threshold. That said, there are a couple of baseline definitions one might use. One (from O’Donnell and Schmitter) is the interval between the original political regime and the one that replaces it. Did that ever happen in Egypt? To my mind, the answer is a resounding no. Mubarak is gone, but his regime never went anywhere. His defense minister and army chief of staff have been running Egypt under the guise of the SCAF, and his last prime minister just participated in a two man runoff to become the next president. That is not a regime change, or even a change of government. There has been no interval between political regimes in this case since the original regime has not been replaced or even deposed.

Another definition (from Przeworski) is that a transition has occurred once a state has arrived at the point where no actor can intervene to reverse the outcome of the formal political process, and the transfer of power occurs from a set of people to a set of rules. I don’t think anyone would seriously argue that this ever occurred in Egypt post-January 2011. Clearly the military has stepped in on a number of occasions to reverse the outcome of formal politics, with yesterday and last week being only the latest and most egregious examples. Egypt has also not really come close to vesting power in a set of rules rather than in the SCAF. It is tempting to describe what has just taken place as an aborted transition, but that implies that a transition was in process against all evidence to the contrary. The old regime has been in power from the start, and just signaled that it has no intention of giving that power up, no matter who wants to call himself president of Egypt. There are lots of different definitions for what constitutes a democracy and plenty of vigorous debate over what is required, but as things stand today in Egypt, it is not a democracy and did not undergo even a limited transition, and pretending otherwise is an exercise in futility and false hope.

Turning Israel Into A Partisan Issue Does Israel No Favors

It is no secret that in the last few years the GOP has been trying to claim the pro-Israel mantle exclusively for itself. This has manifested itself in a number of ways, ranging from the creation of groups whose sole purpose appears to be bashing President Obama over the head on Israel to House Majority Leader Eric Cantor promising Bibi Netanyahu during a one-on-one meeting that the House Republican majority would “serve as a check on the Administration and what has been, up until this point, one party rule in Washington” and that “the Republican majority understands the special relationship between Israel and the United States,” with the unspoken implication being that the Democrats do not. Mitt Romney has accused Obama of “throwing Israel under the bus” and prominent conservative pundits have repeatedly taken Obama to task for alleged mistreatment of Netanyahu. The upshot of all this is a concerted message emanating from the GOP that only the Republicans can be trusted to safeguard Israel’s interests and that the Democrats, and Obama in particular, cannot.

The culmination of this strategy came on Wednesday, when Israeli President Shimon Peres was honored with the Presidential Medal of Freedom, a curious move from an American president who allegedly has no fond feelings for Israel. Many luminaries were in attendance, including Madeleine Albright, Elie Wiesel, House Minority Leader Nancy Pelosi (D-Calif.), Sen. Joe Lieberman (I-Conn.), Sen. Richard Lugar (R-Ind.), Sen. John Kerry (D-Mass.), Sen. Carl Levin (D-Mich.), Sen. Charles Schumer (D-N.Y.) and House Minority Whip Steny Hoyer (D-Md.). Notice anything strange about this list? Ron Kampeas did, which is that it includes only one Republican and nobody from the Republican congressional leadership. It is not because the Republicans weren’t welcome, as Kampeas confirmed from all sides that the leadership delegations from both parties were invited to Peres’s ceremony, but because they chose not to attend. Process that for a second – the president of Israel, who also happens to be one of the country’s founding fathers and a true Israeli legend and statesman in every sense, was honored by the president and only one (involuntarily) retiring Republican senator accepted the White House’s invitation to come. Eric Cantor, who is the highest ranking Jewish member of Congress in the history of the country and who cannot abide what he views as the White House’s various insults and backstabbing of Netanyahu and Israel, apparently thinks that coming to the equivalent of a state dinner for the Israeli president is not an important enough use of his time. Just imagine the torrent of criticism and vitriol that would be raining down on Obama and the Democrats right now if the situation were reversed. I dare say someone would be forming another Emergency Committee.

It seems pretty clear to me that the reason none of the Republican leadership was present on Wednesday is because they do not want to grant Obama a “victory” on Israel or lend credence to the notion that perhaps he is not as anti-Israel as Republicans have repeatedly insisted. It is a shame that one party is desperately trying to turn Israel into a partisan issue that can be used to its own political advantage, but more importantly it is a very dangerous development for Israel’s long term strength and support in the U.S. For decades, Israel has enjoyed nearly universal bipartisan support within American politics, and Republican efforts to paint Democrats as anti-Israel run the risk of turning into a self-fulfilling prophecy and making Israel a political football no different than taxes, abortion, or government spending. I fail to see how making Israel a partisan issue benefits Israel at all rather than solely benefitting the Republican Party, which is misguided behavior coming from a party that professes to be looking out for Israel’s interests. The Republicans are so intent on being perceived as more pro-Israel than the other side that they are actually hurting Israel in the process. The GOP needs to take a step back for a moment and recognize that it is doing Israel no favors by constantly – and ludicrously – insisting that the Democrats can’t be trusted when it comes to Israel’s security, and stop using Israel to score political points. Whether the GOP spurning of the Peres medal ceremony was a dig at Obama or a nod of support to Bibi in the Netanyahu-Peres divide, it was an insulting and outrageous misstep. If you claim to be Israel’s best friend, then you damn well better show up when its president receives the highest honor that the White House can give.
