No, The Israeli Right Does Not Have A Permanent Majority

Dan Ephron, who is Newsweek’s Jerusalem bureau chief, wrote a piece on Monday about the Israeli right wing’s dominance of that country’s politics. Ephron quoted Noam Sheizaf as predicting that the election in January will create a “total collapse of the center-left, both as a political power and as an ideologically coherent idea,” and Ephron appears to agree that this is a likely scenario. The reason Ephron provides is that the fastest growing groups in Israel are the Orthodox and the ultra-Orthodox, and that “both groups lean heavily to the right.” Furthermore, “Since the core motivation for their political hawkishness is largely unchanging—a biblical injunction to maintain Israeli control over Judea and Samaria (their term for the West Bank)—it’s hard to imagine them ever shifting alliances. The upshot: with each passing year, the Israeli right grows stronger.”

This seems plausible on its face, but there are a few major problems with this analysis. First, conflating the Orthodox and the ultra-Orthodox (or Haredim) is a rookie mistake. Orthodox voters and Haredi voters have different motivations and vote based on different issues. The idea that a party like Shas speaks for, say, Israelis attending hesder yeshivot (where draft-eligible Israeli men split their time between army service and Torah study) is nonsense. It is also analytically lazy to contend that Orthodox Jews who serve in the IDF and go on to careers of various sorts are no different than Haredi Jews who do not perform army service and are largely dependent on state subsidies. Lumping their positions and ideologies together makes Ephron’s argument automatically suspect.

Second, it is simply not accurate to describe Haredi rightwing tendencies as being motivated by a desire to hold on to Greater Israel. As my friend Brent Sasley has pointed out, Haredim are generally anti-Zionist or non-Zionist. Not only do they not care about maintaining all of Greater Israel, as Ephron contends, but many Haredim are actually opposed to the idea of Israel at all, let alone an Israel that encompasses the West Bank. Haredi parties in the Knesset recognize the existence of the state, but they do not care about any biblical injunction regarding the land of Israel. In fact, as Brent usefully noted, Rav Ovadia Yosef, the founder and current spiritual leader of Shas (which is the Knesset’s largest Orthodox party of any stripe), held for years that it was acceptable to give up land if it would save Jewish lives, which is certainly not in line with Ephron’s dubious claim that Haredi rightwing positions stem first and foremost from a desire to hang on to the West Bank. Haredi parties generally – although historically not always – band together with other rightwing parties because they are very socially conservative and they feel most at home on the right. Issues surrounding the West Bank or the Palestinians have very little to do with it.

Third, throwing Likud’s politics in together with Haredi politics and pretending that it all stems from the same rightwing ideology is inaccurate. Both segments are conservative and ideological in their own way, but their conservatism and ideology are not shared. Likud is economically conservative and extremely devoted to the settler cause, and if any party has an ideology based on settling the entire land of Greater Israel, Likud is it. There is, of course, the inconvenient fact that Likud leaders are not themselves religious, including Likud founder Menachem Begin and current Likud prime minister Bibi Netanyahu, but certainly a sizable percentage of Likud voters are Orthodox (but not Haredi). Haredi parties are ideological and conservative as well, but their conservatism is social rather than economic – not surprising given how many Haredim survive on state largesse – and their ideology is one of fealty to Torah and Jewish law as a way of structuring daily life, rather than anything surrounding settling or holding onto the land. Likud is rightwing, and Shas and UTJ are rightwing, but they are rightwingers in the same way the Club for Growth and the Christian Coalition are rightwing – they inhabit the same general political universe but for vastly different reasons.

It is true that the Orthodox and the ultra-Orthodox both lean heavily to the right, but that is about the only part of Ephron’s analysis that isn’t stunningly ill-informed. Just because both groups have the word “Orthodox” in their names does not mean that they share the same core motivations. The Israeli right may be growing stronger, but that doesn’t mean that Haredi parties wouldn’t shift their allegiance to the left if they were promised a better deal on subsidies and control of Israel’s religious institutions. Ephron’s permanent majority theory is based on some serious basic factual errors, and given that he is the Jerusalem bureau chief for one of America’s most prominent newsweeklies, I expect some more rigor from him.

Mr. Netanyahu Goes To Turtle Bay

Bibi Netanyahu gave a widely covered and dissected speech to the United Nations General Assembly yesterday in which the main takeaway seems to be that he watched a lot of Warner Brothers cartoons during his time as a teenager living in the U.S. Brent Sasley and Jeffrey Goldberg both weighed in on what Netanyahu was trying to accomplish, and Ali Gharib pointed out that Bibi actually made a mistake with his cartoon bomb, so I don’t need to rehash what others have already eloquently written. Instead I’d like to pick up on a theme that Robert Wright captured, which is that Netanyahu essentially conceded that Israel will not be bombing Iran any time soon. As regular O&Z readers know, I have thought for months that an Israeli strike is unlikely to happen, and so now that the conventional wisdom has caught up with me, it is worth rehashing why most people thought that an attack was going to happen during the summer or fall.

The thinking in the DC foreign policy community on an Israeli strike has largely been shaped by the notion that the decision to attack lies with Netanyahu and Ehud Barak, and so the speculation over whether Israel was on the brink of striking Iran’s nuclear facilities broke down into two camps. On one side are those who believe that Netanyahu and Barak are deadly serious about a strike. They view Israeli saber rattling as an effort to prepare the Israeli public for war and think that the reportedly reluctant Israeli military and political leadership will line up behind the prime minister and the defense minister once they decide to order military action. On the other side are those who believe that Netanyahu and Barak are engaged in an elaborate bluff designed to either pressure Iran into ceasing its uranium enrichment program or to convince the United States to handle the job of taking out the Iranian nuclear program. Israeli chatter about the looming threat from Iran is aimed at creating conditions under which the U.S. feels it has no choice but to do everything possible to prevent an Iranian nuclear weapon and convincing the Europeans to back harsher sanctions on Iran. In this reading of the situation, the rest of the Israeli military and political leadership do not matter because Netanyahu and Barak are only interested in creating the perception that they are going to attack.

The question then of what Israel is going to do turns on Netanyahu and Barak’s true mindset; if they are serious about attacking they will attack, and if they are bluffing they won’t. It is a very simple dynamic, leading to an entire cottage industry designed to ascertain what precisely the two men’s intentions are, with an increasing focus on Barak – or, per his feeble attempt at anonymity, the “decision maker” – as the key figure. In this increasingly accepted view, there are only two possibilities and two outcomes, and the only people who matter are the Netanyahu-Barak tandem.

What this discussion has entirely missed, however, is that there is a plausible third outcome, which is that Netanyahu and Barak are dead set on launching a military operation against Iranian nuclear sites but that such an operation will not occur. People have discounted this possibility because they either misread the way in which national security decision making takes place in Israel or discount the Israeli political climate.

Netanyahu and Barak are not the only people who matter in this decision. When an American president wants to go to war, he generally gets his way irrespective of what his cabinet or generals want to do, with the Iraq War a good demonstration of how the president is truly The Decider. In contrast, Netanyahu and Barak will not be able to launch a strike on Iran without the near unanimous consent of the inner security cabinet and the larger political-security cabinet, and such authorization is not assured. Four of the nine members of the smaller group are currently believed to be opposed to a strike, and the fact that Netanyahu briefed Rav Ovadia Yosef in order to flip Eli Yishai’s support speaks volumes about Netanyahu and Barak’s power to order an attack against other ministers’ wishes.

There are also important constraints on Netanyahu and Barak’s decision making. Israeli public opinion does not favor a unilateral Israeli strike, the home front is woefully unprepared for retaliation from Iran or Hizballah, a myriad of current and former IDF and intelligence officials believe an attack is a bad idea at this point, and the specter of the Winograd Commission – which blasted former prime minister Ehud Olmert and the IDF chiefs for the 2006 war in Lebanon – hangs over everything. All of this is particularly salient given Netanyahu’s historical risk aversion when it comes to ordering military operations of any sort, compounded by the fact that this is an operation whose chances of success are seen to be limited to delaying Iran’s nuclear program rather than ending it and might end up with thousands of Israeli civilian casualties as retaliation. That the Obama administration is also opposed to an Israeli strike is an enormous constraint on Netanyahu given Israeli reliance on U.S. munitions and aid.

In the aftermath of yesterday’s speech, there is a rush of commentary focusing on the fact that Obama looks increasingly likely to be elected and so Netanyahu feels like he needs to back off and not risk angering the White House any further. I am sure that is part of what is going on, but this narrative implies that Netanyahu would have ordered a strike by now if Romney were ahead in the polls. I think that is wrong, and misses the fact that there is lots going on here on the Israeli side and that the U.S. is only one of many variables in this equation, and perhaps not even the most important one. If the focus is exclusively on the argument that U.S. pressure has sufficiently convinced Netanyahu to change his plans, then analysts are guaranteed to get it wrong again in the months or years ahead when trying to figure out what Israel is going to do.

This Is Why Bringing Religion Into Politics Is A Bad Idea

Last week I wrote about Bibi Netanyahu’s attempt to use religious authority to create support for a strike on Iran. There are many problems with going down this path – and I should add that Netanyahu is not unique in this regard; there is a long history of Israeli and even American officials seeking Rav Ovadia Yosef’s approval for various national security initiatives – but one of the bigger ones is that once you allow politics to be influenced by religion, you can no longer control the deluge that is guaranteed to follow. To wit, Netanyahu has to deal with the fact that he is being publicly challenged by influential rabbinic authorities on implementing the High Court’s order to evacuate Migron, the settlement outpost that was built on land privately owned by Palestinians. Rabbi Elyakim Levanon, the chief rabbi of the Shomron Regional Council and a past ally of Netanyahu, declared over the weekend that if the prime minister attempts to “raise a hand on Migron [he] will have it cut off.” He also made implicit threats that the IDF will have to disband if the government offends the religious Zionist community since if yeshiva students stop joining the army on the orders of their rabbis, “there will be no army. Who will join the army? Those who raise two kids and a dog?” He took great pains to let everyone know that he wasn’t actually threatening the prime minister, but simply hoping that God makes his words come true.

This is not the first time that Rabbi Levanon has attempted to use religious pressure to change or influence government policy. This past January, he quit his position as head of the Elon Moreh hesder yeshiva (hesder yeshivot allow observant Israelis to combine army service and Torah study) because he vehemently disagreed with an IDF ruling that soldiers could not walk out of events in which there were women singing. Before quitting, he had given an interview in which he said that the IDF was “bringing us close to a situation in which we will have to tell [male] soldiers, ‘You have to leave such events even if a firing squad is set up outside, which will fire on and kill you.’ I hope the army rabbinate will bring in some wise figures who will stop this terrible state of affairs. But if there are no such rabbis, we won’t have any choice, and I’ll recommend to anyone who asks me about the IDF that he shouldn’t enlist.” Given Levanon’s position as head of an influential hesder yeshiva and as chief rabbi of the Shomron Regional Council, which oversees 30 settlements in the West Bank, his thoughts on such matters cannot be simply brushed off, and his comments on Migron represent only the tip of the iceberg of what is to come from the religious settler community should the High Court decision be enforced.

This ties into the excellent piece by Dan Byman and Natan Sachs on settler terrorism in Foreign Affairs, in which they argue that Israel needs to treat settler violence the same way it treats Palestinian violence and that “mainstream rabbis should denounce their radical brethren and demonstrate how their views contradict centuries of religious tradition.” They are correct with this recommendation, and there is already a growing movement to do exactly that. The problem, though, is that the involvement of rabbinic authority goes both ways. If the Israeli government is to appeal to religious tradition to convince the violent settler fringe to cease its terrorist activity (and if you need any convincing as to how deep the fanatical rot has penetrated, the three suspects in the firebomb attack last week are 12 and 13 year olds from Bat Ayin, which is known for having something of an artsy and hippie vibe), it then makes it tough to operate when religious authority dictates that the government is doing something that contradicts Jewish law, which is what Rabbi Levanon contends is the case with evacuating Migron. Bibi runs to Rav Yosef when he wants to pressure Eli Yishai into supporting military action, but nobody should fool themselves about what this means when the government decides to give an order to evacuate a settlement. Religious authority is not something that can be turned on and off with a switch, utilized when convenient and ignored when not. Netanyahu is going to have a serious problem on his hands with Migron and other settlements down the road, and the fact that he so brazenly and nakedly uses religion for something he regards as a priority is going to haunt him when religion operates to stifle actions which he has no choice but to take.

Bibi’s Shameless Religious Gambit on Iran

Bibi Netanyahu and Ehud Barak have run into the problem that they appear to be virtually alone when it comes to deciding whether to strike Iran’s nuclear facilities. The two are so out on a limb at the moment that Shai Feldman, writing in Foreign Policy, declared the debate over attacking Iran to be over because Netanyahu and Barak lack the minimum consensus that would be required for military action. The defense and intelligence establishments are united in wanting to wait for the U.S. and not wanting to attack Iran unilaterally, and until Avi Dichter was added to the security cabinet formerly known as the Octet last week (which means that it is no longer a shminiya but a tishiya), the vote to attack Iran was reportedly split 4-4. A lot was made of the fact that Dichter is presumed to be on Netanyahu and Barak’s side and that adding him to the mix breaks the logjam, but I didn’t write anything about that last week because it is a faulty and ill-informed argument. A 5-4 vote is not going to be enough to launch a strike given the heavy opposition that exists to such a move; Netanyahu and Barak need to do some serious convincing and make real headway with the holdouts, who are Benny Begin, Dan Meridor, Moshe “Boogie” Ya’alon, and Eli Yishai.

It is this last name that is perhaps the toughest to move, because Begin, Meridor, and Ya’alon are all members of Likud and presumably Netanyahu has some more sway with them since he is their party leader (although my hunch is that Meridor, and to a lesser extent Begin, would never flip). Yishai, however, is a member of Shas, and that’s how we get to the outrageously cynical ploy that Bibi tried yesterday. For the uninitiated – although since you are reading a niche blog about Israeli politics right now, you probably don’t need this background – Shas is an ultra-Orthodox Sephardic party whose spiritual leader, Rabbi Ovadia Yosef, controls how its members vote despite not being an elected official of any kind. I wrote about this dynamic back in May, when Rabbi Yosef ordered Yishai to change his opinion on being willing to consider alternatives to the Tal Law. What you have in Shas is a theocratic party, in which the elected politicians are beholden to the party’s rabbinic leadership and dare not contravene rabbinic orders when it comes to taking public positions or voting on issues in the Knesset or the cabinet. With this in mind, yesterday Rabbi Ovadia Yosef – who holds no elected or official position in the Israeli polity and has zero to do with Israeli national security – was the recipient of a national security briefing on Iran. Not only was he briefed, but it was done by Yaakov Amidror, the head of the Israeli National Security Council, lest anyone think that this was not a big deal or little more than a courtesy for a former chief rabbi of Israel.

Make no mistake about what is going on here in case it isn’t already abundantly clear: Netanyahu is trying to swing a vote to launch a strike against Iran by convincing a religious leader to order an acolyte to vote a certain way. He is not trying to convince Yishai by making a cogent case for military action – or perhaps it would be more accurate to say that he has given up trying to do it this way – but is going above his head to Yishai’s rabbi, whom he knows Yishai is bound to follow, and telling a man with no national security experience at all and no training or education in evaluating intelligence or threat assessments that it is crucial to bomb Iran. Does anyone think that Amidror, a general and Israel’s equivalent of Tom Donilon, had any trouble at all convincing Rabbi Yosef about the urgent need to strike now in order to prevent Israel’s annihilation? For all of the outrageous things that go on in politics, and Israeli politics in particular, this represents an absolute low. It is a naked appeal to religious authority made to a theocratic party in which politicians serve as mouthpieces for rabbis. The reason that Shas has never taken an interest in foreign affairs is because its spiritual leaders don’t care about the issue, and to prey on that ignorance in order to influence a crucial position on national security is nothing short of abominable.

There are two conclusions to be drawn from this sorry and craven episode. First, Netanyahu is desperate since he realizes that he is fighting a steep uphill battle and he will resort to anything, no matter how blatantly insulting and undemocratic, to get an advantage. Second, Netanyahu and Barak’s argument for an attack is not only falling on deaf ears but is so weak on its face that they both know it cannot win on its own merits. Briefing Eli Yishai’s rabbi is not a move made out of strength, but one made out of a position that is even weaker than anyone could have realized. If this svengali routine is the best that Netanyahu can come up with, I hope for his sake that he has something better when it comes to the rest of his security cabinet, since unlike Yishai, the three Likud holdouts do not answer to a higher authority.

This Is Why Rabbis Should Stick To Torah Rather Than Politics

A committee is being established to come up with an alternative to the Tal Law, and the deal that emerges will affect Israel’s Haredi community more than any other segment of society since it will determine what becomes of the system whereby Haredi Jews are granted exemptions from military service. So naturally, one would expect the Haredi parties to be intimately involved in coming up with new proposals and fighting tooth and nail to get as many seats on the committee as possible. Right?

In fact, the Tal Law committee is being boycotted by Shas and UTJ following rabbinical instructions to the parties’ MKs that they should not participate since the Haredi rabbinical leadership is ideologically opposed to compulsory military service for the members of its community. Shas head Eli Yishai, who was previously on record as being willing to consider alternatives to the Tal Law, changed his mind after meeting with Rabbi Ovadia Yosef and now says that he is against any negotiations or quotas and that the right of Haredim to study Torah should not be subject to debate. Instead, Shas is going to come up with its own plan for draft reform outside the auspices of the official committee, while UTJ has threatened to leave the coalition on the orders of its own rabbinical leadership should Haredi students be prevented from studying Torah all day.

Boycotts of politics never end well. All that happens is that politics proceeds apace, and the parties that choose not to participate do not get to air their grievances, promote their interests, or affect the results in any way. This is particularly true when the boycotters are not protesting the legitimacy of the political system itself, but rather a specific policy that they do not like. Shas and UTJ are not taking a stand against the Knesset’s legitimacy; they just think that the people they represent should be allowed a different set of rules than everyone else. Now, it is understandable that they think this way, since for decades they have indeed had a different set of rules that were endorsed by the Knesset, the courts, and the other organs of Israeli democracy. The corollary to this though is that if the old rules were deemed to be legitimate, then any new rules that emerge must be deemed legitimate as well.

It seems to me that the Haredi politicians understand this. Yishai seemed willing at first to be involved in crafting a compromise, and apostate Shas MK Haim Amsalem has blasted Shas for not participating in the committee. It is only on the orders of the various rabbis who comprise Shas and UTJ’s “spiritual leadership” that the two parties are now boycotting the committee rather than serving on it. This appears like a logical step to the rabbinic overseers, since like anything else that conflicts with their interpretation of halakha – immodestly dressed women, “secular” music, the internet, etc. – their approach is to ban any contact with it. In their view, the Tal Law committee is going to force Haredim to stop devoting all their time to learning Torah, and since they consider this to be unlawful from a religious standpoint, they will have nothing to do with it and have instructed their MKs accordingly. While the religious logic of this might make sense, the political logic does not. What is sure to happen now is that a compromise will be worked out that will not be to the Haredi parties’ liking, the Haredi community and its leaders will reject it as illegitimate, and Israel will have a new problem on its hands. I do not begrudge the Haredi parties their reliance on rabbis to influence their policy proposals. In a democracy, any party has the right to organize itself as it chooses, and this applies to religious parties just as equally as it applies to anyone else. The Shas and UTJ MKs, however, know enough to realize that religious expertise is not the same as political expertise, and when the rabbinical leadership begins to control tactical political decisions rather than broad policy preferences, it is going to lead to political disaster.
